As a student developer, I received both a retail and upgrade version of Jaguar and a retail and upgrade version of Panther. So it's not uncommon.
Make sure the upgrade version does not say NOT FOR RESALE somewhere on the CD label or included license agreement before you sell it on eBay. You may be violating your student developer agreement by selling your ADC copies.
If the agreement says you can't sell your copies, don't. You owe the winning bidder of your auction a legitimate "retail" installation dvd AND a legitimate "retail" license agreement.
