when to expect 4.0 apps?

Then, as a registered developer, he'd already know the answer. Or he should not have the beta.

If a developer has an app that's compatible with both 4 and 3 and is ready now then why wouldn't they submit it now?
And why wouldn't Apple approve it now?
I see no reason why we couldn't see 4.0 apps showing up any day now. Except, of course, if none are ready yet. But I can't think of any reason other than that.

Apple will not approve any apps built against the 4.0 SDK or even with the beta version of XCode shipped with the 4.0 beta (no matter if you choose a 3.x SDK or not). So you won't be seeing 4.0 apps any time soon.
Why would a 4.0 App come out without a 4.0 OS to run it?
If it isn't using any 4.0 features, just call it 3.X.

Apple will publish a notice to the devs on when they can begin submitting the apps. For 3.0 I think it was about 2 weeks prior. The ones that got approved showed up in the store the same day 3.0 was available for download. There's no beta App Store for 4.0-compiled versions of apps, although the devs have been requesting such a thing. The only way of getting 4.0 apps now is to write your own.
