When you buy an iphone .....

When you buy an iphone at a US apple store, do you need to sign up for a contract with AT&T at the checkout, or is this done via itunes afterwards?

I want to buy an iphone for 399 from the apple store, but dont want to sign up for AT&T and jailbreak it instead.

Ebay charges silly money for unlocked phones, but since I can unlock it myself I am hoping I can just buy a locked phone.

All you do in store is pay for the iPhone. You can unlock via Independence or Ziphone.
