It's not that they're Android, but rather, the caps are on the HSPA+ models...my SE Xperia X10a pulls data just as quickly as an iPhone.

Looks like HTC is upgrading their HSPA+ phone. Update soon it looks like.

it looks like Inspire 4G owners will not have to wait much longer for 4G. Test reports for the Inspire 4G show approval for HSUPA and HSUPA+ goodness on WCDMA bands II and V, which should translate to a nice bump in wireless data speeds. No word on when this upgrade will actually occur, but we’d guess that a software update will be pushed to users soon.

Yep. Pretty much. All of AT&T's moves lately have been to help mitigate bandwith usage.

Limiting data speed on phones, sending text messages to stop tetherers and buying up t-mobile's network.

Is this a hardware mod or software?
 
I think its more of AT&T caps upload speeds on phones that are actually capable of using a lot of bandwidth (an Atrix will strain the network more than a razr). thing is though, Apple is very protective of their stuff and does not allow AT&T to touch it. Therefore, higher upload seeds on iPhone.
