Why does it cost more to upgrade...

1) Why does it cost more to upgrade from the 3g to the 3gs than it does to just buy a 3gs?

2) If i use at&t right now, but do not use an iphone or 3g service, do i pay the $199 price for the 16g 3gs or do i have to pay the upgrade price?
