the very top section where the menu bar was only shows desktop that cannot be used, when maxmise window, or drag a window to use the space, it does fill it up until you let go of the trackpad, and it always positions itself just below where the menu bar was, meaning there is no difference to desktop space

I'm unable to replicate this on my work machine, which is admittedly running the previous OS. Can someone else on 13 give it a go?
 
I'm running Ventura. I can place windows into the space previously occupied by the menubar.

its good to hear l should be able to make use of the whole desktop, its a 2023 macpro 14", bought in August23, with ventura 13.5.2. why cant l maximise or make use of the 'small' upper section where the menu bar was?
 
You can't put stuff in there because it's not really free space, it's reserved space for the menu bar even when the bar is hidden since when you mouse over it, it reappears. The windowing system knows this so it puts the windows below this reserved space.

Basically hiding the menu bar is decorative only if you're on a computer with a notch.

I have two external monitors connected to my MacBook Pro that has the notch. I had only tested with those monitors. After your post, I test with the laptop's monitor; I can't place anything into the empty areas adjacent to the notch.
 
On an M2 13 Air / Ventura 13.5 I can place anything on the Desktop, adjacent to or behind the notch; but app & finder windows drop back once let go - as the OP describes.
 
so no way of us using this unused space? l never connected to external monitor, but its still same for them too? i don't remember this wate of desktop space in my mbpr 2012

why dont apple allow max space??! reckon it will come with new updates?
If you use an external monitor you can use all of the desktop space when hiding the menu bar.

On your main laptop screen the menu area is not usable due to the notch being in the middle of the screen. Closest you can get is 3rd party blackout apps or in full screen the area is blacked out with the menubar hidden.

Would not expect Apple to change this in the future.
