Will my Apple store give me any problems?

I bought a week 38 iPod Touch during the second week of October, but I haven’t opened it yet (my current system is glitchy and won’t load iTunes no matter what; I have to wait until early December when I can afford an iMac). I’ve been looking over this forum and noticed that most people seem to have very little problems with their week 38 touch, but others still have had issues and a couple of people recommended to another person on here that he go ahead and exchange his week 38 touch just in case.

My question is do you think my local Apple store would give me any hassles if I simply told them that I wanted to exchange my current one for another one simply because I don’t want to take any chances that it’ll still have any lingering problems from the week 36/37 batches? I have the day off on Friday, so I plan to make an appointment for that day.

I think it will all depend on the store, but it can't hurt to try!
