Yeah for the non subsidized price.
I don't think so. I think you'll have to pay full price and renew your contract.
I think they stopped requiring that so they can get rid of inventory (mainly the 3G) to make room for the upcoming model in the lineup.

3G and 3GS were not available off contract until about 9 months after release.
Most likelly the same this year also.
They want to first serve/sell to the contract users and then when stock is plenty start selling no contract iphones.
That sucks. I'm willing to pay the full price for the new iPhone.
There should be plenty of them up for sale on ebay and CL after its released.
