The lawsuit occurred in 1999. They were first bought in 2004. If the lawsuit had driven them out of business, I sincerely doubt it would have taken 5 years to do so. But I could be wrong.
They were successfully sued by Apple in 1999. It didn't force eMachines out of business like you suggested and they were bought out by Gateway 5 years later in 2004.
