That article is misleading. SCOTUS won't wipe away the entire first sale doctrine even if it fully affirms the lower court's decision. Also, this would apply to products that are made abroad and only sold abroad, and if then someone imports them and sells them as new domestically. This decision would not apply to used stuff (largely falling within the fair use doctrine), nor to all things made abroad (the first sale doctrine would still apply if it was first sold in the US).
