Would you sue your parents because you fell down in their driveway?

If anyone is an idiot in this case it would have to be...

the U.S. District Judge.

If Judges keep allowing such crap to happen there is no stopping the motivation to sue left-and-right

I agree that we need to maintain a safe environment for all family, friend and others - but lets be serious for a moment. Shouldn't common sense be a requirement to concider before allowing any legal action (and I have no legal experience to base anything on)?

Was there ice on the driveway? Was it foreseable that you would fall on your ass if you did not take care on this ice? If the answer is 'yes' to the second question then there should not be a legal ground to stand on (no pun intended!)

Just my two non-legal-minded cents...
 
The people who blame the judge really have no clue as to how the judical system works. You guys really think the judge has that kind of power to throw out cases willy-nilly? Last year I had to appear for a trial where the other side already withdrew the month before just to do it by the book.
 
Never, never, never. Even if it was for a large settlement of money. Seriously. I am so indebted to them. They have given up most of their lives, money and relationships to raise me and my three brothers. Why would I want to turn around and sue them?

Even if that sort of negligence caused me to break some bones (happened alot of times :D ) I would not try to "teach them a lesson" and take away all their hard-earned money. What type of injuries I've had were my own fault and not theirs, because they've told me from the beginning that I could comprehend commands, to not do things that could injure myself.

Moral of the story:
People make mistakes. We must be more forgiving.

I though Judges could make a summary ruling or something to that effect - sure if there is clear evidence of negligence on the part of the parents the case should proceed. And I re-read the original article after it was implied I had no clue how the judicial system works and I assume becuase the fact that it is unclear if the drainage system was faulty and contributed to the accident, and if the parents were aware of the fault - is why the case is moving forward.

So, I withdraw my comment regarding the Judge being somewhat of an imbicile as it is clear the imbicile is more than likely me - I am in Japan after all and the law works very differently here...if at all
 
Family members suing one another is actually much more common than you would think. The reason is because you cannot sue another person's insurance company directly. Often, one family member gets in an accident and another family member has insurance that would cover the injured family member's medical bills and other expenses. However, if you have ever dealt with an insurance company, you know that they will do anything they can to delay and deny paying a legitimate claim. To force the insurance company to pay, the only available avenue is to sue the family member who purchased the insurance policy and then the insurance company has an obligation to legally defend the person and pay any settlement or jury award. Usually the person being sued has no objection to being sued and is very angry with the insurance company for denying the other family member's claim. I don't know the facts of this story, but I am willing to bet a lot of money that is what is going on here. That is why people buy insurance, to cover accidents that happen on their property. After paying the premiums for years and then an accident does occur, the insurance company frivolously and fraudulently denies the claim and forces you to sue your own mother. Anyone want to start a colony on the moon? Insurance adjusters and not invited.
 
Yes I would, I'd sue her for being a heartless ****:mad: but not for slipping on the drive way that would of been my own fault :eek:
