Do you actually know what a "3rd-degree burn" is?? It's where you burn the skin so much that it damages the epidermis (surface), dermis (main layer) *and* the subcutaneous fat below. 3rd-degree burns result in blackened, charred skin that can not heal, and typically required large amounts of skin to be removed and replaced with grafts. This kind of burn is the sort of thing that happens to people who get stuck in a burning house for a long time, not people who spill a hot liquid on themselves. Coffee, no matter how hot, will evaporate and cool off long before it can cause that kind of damage. I'm betting the worst you could get from spilled coffee is 2nd-degree, and even that would have to be some pretty damn hot coffee...

And 2nd degree may over time progress to 3rd degree

So you think you know it all, eh? Visit the link below, please:

Warning: Graphic in nature

That's the actual picture of the actual plaintiff who sued McDonalds, Stella Liebeck. The coffee was likely near 185F and pooled in her groin area and thighs only for a few seconds causing 3rd and 2nd degree burns. She underwent skin grafts and 2 whole years of followup medical care.

Now, let's get real here - a broken nose is nothing close to the pain and procedures as in the McDonalds case. However, facts are not always as simple as they seem at first, so always keep an open mind and never assume anything.

Uh, do your research, they were 3rd degree burns.

HEre's one site talking about it:
http://www.slip-and-sue.com/the-famous-infamous-mcdonalds-coffee-spill-lawsuit-revisited/

Where they say she had 16% of her body with 3rd degree burns.

And that is the point, the coffee was *that* hot. And that was one big reason McD's was getting sued (and had been sued before). Because coffee shouldn't be that hot to be able to cause that degree of burn.

And I guess you'd lose that bet. Since that case proved you can get 3rd degree burns from coffee.

You said the cup was placed in between her thighs though. That's not where the cup was located. It was not in her lap - it was between her knees outside of the area where the coffee got spilled - back behind her.

And the location isn't really relevant anyhow. If one reads the case file, the court concluded that the spill itself was her fault. That is not contested. What was the point was the extensive burns that she received because of the spill were far excessive based on expected temperatures.

You're replying to the wrong person.

How come her walker didn't hit the glass first?

Another link that's lacking in information. Why was she allowed to disembark while the propeller was still in motion anyway? Even in small planes that isn't normal.

Yes, she exited the plane (it was a private aircraft). The owner's insurance policy pays claims up to $200,000 per passenger, which is what they offered.

Get this - she is claiming she was not a passenger at the time she ran into the propeller!

Honey, if you weren't a passenger, then you were a trespasser. Take the $200,000 and call it a day.

And while I am at it, I have to ask - $75,000 in actual damages? You can get a whole new nose for $10,000!
