I talked with a CS rep last week, and she told me that if I order my iPhone 4 with a new 2 year contract that AT&T would waive the activation fee if I order my phone via telephone.
 
I called and politely told them that I've been a customer since 2005, bought an iPhone at full price in 2007 and have not upgraded until now. Please remove that fee or cancel my account. Fee removed without any issues.

It seemed like it. An hour after waiving both my fees, my phone activated.
 
Had to pay a full upgrade price of 499.00. Was not in the mood to fight in the store.

Came home, still not activated. Upon activation, I had no VM, or Data. Got around to calling last night at 12AM. For the first time ever since 2007, I had an absolutely kind, smart, and go out of her way rep at AT&T. She told me wow, your data is not on the account, that's strange- you want unlimited- done. Now for your VM, looks like that got zapped in the upgrade, sorry about that.

I asked her about the 18. fee, she said, waived sorry for the trouble. I then asked why I had to pay full price for the phone at 499? I have only upgraded once in 3 years- and our bills are paid timely.

She paused, and said- hmmm your right, how about a 200.00 credit, that is the most I can offer. I of course said that pays for my upgrade cost, and took it extending sincere gratitude for not having to fight or grovel.

It seems yesterday that the AT&T service reps just got a new training manual because for a moment I thought I was on with T-Mobile our other provider.

Cudo's AT&T, I give you thanks and praise.

P.S. then this morning I could not send txt or do Facetime (they are linked btw), had to call again... My texting plan got axed too- no biggie, fixed in about 4 min.
 
I guess the midnight crew doesn't care and don't mind breaking a few rules. Both reps I spoke with at midnight were much better than mid day reps.
 
So, before I ordered my iPhone 4, I typed in that *639# on my iPhone 3GS and it said that I was eligible for an upgrade and would have the $18 fee waived.

I just got my bill and it has the $18 fee on it! I called CS and they said there are no notes saying that I was eligible for the $18 fee to be waived. WTF? Anyone else get screwed over by AT&T on the upgrade fee?

Wow Im in the EXACT SITUATION as you. The number said it would be waived, but the bill came an there it was.. the 611 guy even said the facebook at&T page is run by hackers...
 
Two years ago I called premier support and said my activation fee was supposed to be waived and she apologized and waived it immediately. :)

I was never charged an upgrade fee either.
