I don't understand people who think that App Store is generic.

What do you think if you walked into a CVS Store and saw a sign "Winter is here! Get your kleenex and bounty stocked up!"? Then you walk to the isle to find CVS branded paper towels and tissue papers looking like those brands but not them at all.

I don't think that's fair, and CVS does this all the time. There's an expensive bottle of shampoo on the shelve and right next to it is CVS' one looking exactly the same, same colors, shapes and design, just a slightly different name.


This is just a free ride for Amazon, Google and Microsoft and they know it.

Were they worried that lay people might visit another companies "App Store" by omitting their own, well know company name before it? Nope.

And why do you think that is? Because "Apple" or "iPhone" have over time and ubiquity become implied and associated with "App Store". I'd be bummed out, too. :)
 
the full trial is not set to take place until October 2012.

Until then, Apple and Amazon are free to pursue each other.

Apple is looking for some form of injunction or penalty against Amazon, though on the trademark grounds Apple hasn't got one yet, and probably never will.

I hope Apple drops the trademark issue. It's clear, at least from a lay perspective, that that's a lost cause.

They might have chance in the "willful misrepresentation" line, however. Probably plenty of fodder there.

I think we're seeing an Apple vs. Samsung-type battle play out here. Pretty soon we'll be seeing Apple vs. Amazon news.

Hopefully Amazon will be a little brighter in the courtroom.

This is one of those rare occasions where I completely agree with what LTD said.

I dont think Apple should be given rights to the term 'AppStore' as it is way too generic. Sure, if they had filed for it when the AppStore came out, and made sure competitors didnt use it then fair enough...but to let everyone and his dog use the name, THEN go after them just seems silly.

Well since they were running in on an Apple ad - or promotion - it's obvious who's app store. Why would Apple be promoting apps for other hardware.

App Store to me is too generic. We've all discussed this throughout the past year or two. To me - it's like trying to trademark "shoe store." It's not unique. If Apple wanted to trademark AppStore as one word or such - they might fair better. But they object to App Store in total. And I think that's over-reaching. Personally.
 
Really? Apple, you are saying your users are too stupid to know the difference between Apple's App Store and Amazon's App Store?

Seriously, that is about what they are saying and I don't buy into it. It is clear they are different stores.

Also, App Store was used before iOS, as I recall it was on one of the Wireless carriers, as well as on one of my Nokia phones, so I think Apple would have a hard time establishing that they have a right to the trademark. Perhaps the courts will see this and order Apple to change it, who knows?
 
I've got to say that Apple does have a point with confusion. My brother-in-law swears that I should go to Android from my iPhone. When I say that its not practical because I'd have to re-purchase hundreds of dollars in apps that I use regularly he swore that they would still work because they're from his AppStore for Andriod.

I'm sure there are a lot of other people who believe that because they have the same name its the same across the devices.

yeah, totally. My father's brother's nephew's cousin's former roommate told me that he has a "computer" and can't get iLife to load on it. That silly guy has a pc, not a mac. It won't load. I'm sure that a lot of people that think they have a "computer" think that mac stuff will work on it because it's marketed as a computer program. I sure hope apple sues somebody so this gets cleared up.

Marketplace is to Android
as AppStore is to Apple
you don't see Apple using other marketing terms from various vendors as much as you see them using successful Apple terminology.

Next you will hear people saying my iPod player when in reality they mean some other MP3 player, ooh wait too late!
 
Apple's "App Store" (two common words) is actually pretty generic compared to Amazon "Appstore" (almost a new word).

Apple's lawsuits against the Kindle Fire and (because of?) the Appstore name don't seem too valid.

Theres a monumentally huge flaw in your logic there.

Kleenex = A brand.
Bounty = A brand.

App = Application

Apple gave their store a very generic name, as did amazon. You cant stake rights on something like that.

If your local grocery store called their shop 'GroceryStore' they would in no way own the rights to calling a grocery store, 'GroceryStore' - this is the exact same logic, in every single way shape and form.


The reason for the lawsuit is just an opening into a lot of lawsuits against the Fire. Just like the Galaxy, its a potential threat to the iPad, so Apple will naturally do everything they can to disrupt the product.

You would be surprised to know there really are some people out there that think you can run any program on any computer.

People talk about App Store being generic. It isn't. The name didn't exist before. Isn't "Apple" generic by the same logic.

If you create a name for a business that is unique you can protect it. Often those name can be simple. Apple have used a name that has stuck so damned well that others want to use it.

Apple are very good at this. I remember before Apple launched there tablet everyone called what they had a tablet or slate. Apple introduced the word Pad and then a whole bunch used the same name. They never sought protection of this name and it may have been used prior. It's just a good example of Apple naming products and services well.

On another note... Google music's cloud logo is a damned close likeness of the Apple cloud. In fact when i saw it the logo invoked an image of Apple in my head. Very clever Google. For now. Apple has to expect people will try and piggy back them. And they need to respond.

funny, cause i was never able to get my brother to get an iphone because he would have to spend hundreds of dollars in apps to do what he can do for free on android. i finally listened to mine, you should listen to yours.

When the first iPhone came out and Apple pushed the term as their store and the "App" branding then it became a term everyone knew. Then of course it feels generic, but really no - its not generic at all. Its a common phrase NOW but pre-iPhone most people had never heard it used.

I don't quite agree with you! And who tried to use the iPad name? Or Pad in their name period. Prob some generic company that isn't making any money whatsoever. No one big at least not at all that I have heard.

Creating a name for a business is one thing but just using a abbreviation of another word I don't think works. Application is so widely used and to just try to take App. That is ridiculous! :rolleyes:

Yes, it was. "App Store" existed on a number of mobile phones, pda's, etc long before the iPhone was even conceived.

Who should? Again, for years and years and years the term "App" has been a well known abbreviation for "Application". Apple were not the ones who came up with some kind of genius idea to shorten the word, they just used its shortest form because obviously "Application Store" is a lot longer.

I'll say once again for those who are still a little slow. There were MANY application stores called "App Store" BEFORE Apple even thought of the iPhone.
 
Apple should get hostile...

Android as "Windows of the 2000's" is out of hand and Google is a publicly traded company. This is a situation where Apple just needs to use their powers of influence to stage a hostile takeover of Google and kill Android once and for all.
 
Wow, Apple has gotten so petty now. If they can't beat the competition they're going to try to sue them out of existence. Be aware of what comes around, goes around. Apple has copied so much from others they have a big fat round target on their backs with an Apple for a bulls eye.
