This was definitely one of the more ridiculous lawsuits. Very few courts are going to come to the conclusion that anyone but the most dense individual gets confused between the Apple App Store and the Amazon App Store. It was a pointless lawsuit from the get-go.

Like a Dense Lawyer downloading an HD video for his SD iPhone!:p
 
That's like saying that it's OK for Honda to make the Ferrari 458 Italia because nobody is going to see it and confuse it with the real Ferrari.

ETA: It's more akin to you selling a box that only accepts round widgets and another person selling a box that only accepts square widgets. You both have a store - and you want to own the term widgets. The other person has a store called My Widgets - and you sue because you think there will be confusion.

And even THAT is a bad analogy. But it at least is a closer "fit"

Ah. Conceded. That term is vaguely familiar (I think I saw it on an ad for a Tron sequel a while back).

Like I pointed out to samcraig , I'm relatively "new" to the industry. I still don't recall the term "app" in the Windows world, but that's just me. The only computers I used regularly in the eighties and most of the nineties had controllers attached to them.:p
 
Well, they settled the case against Lindows and bought its trademark because they risked losing the Windows trademark

Well that's good news. The whole thing seemed trivial to me over what the generic term for the 'App Store' and 'appstore' was as I agreed with Amazon and Microsoft on this 'issue.'

Now, with that settled, perhaps Apple and Amazon can work on bringing Amazon Instant to the Apple TV. Wouldn't that be nice?

Explain to me the difference. And remember, I'm not talking about the lawsuit, just the argument a lot of people use: "Nobody is going to confuse them even if they have similar names or the same name."

Perhaps you can try with Ford Motor Store and Ducati Motorstore, it could be a little closer to this case

So let me get this straight...when Apple is involved in lawsuits, there is no money to spend on innovation? Everybody stops working for the duration of the lawsuit?

I must assume this is the case since the sentiment expressed in the quoted post so often appears...it's either one or the other, but never both going on simultaneously.

So you are saying Amazon won this battle but Apple is winning the war. This seems reasonable. I don't think most people think of anything other than Apple when "App Store" is mentioned. Amazon can call their store the same thing but it will probably end up helping Apple because of the association. Amazon should try to find a different phrase to differentiate themselves.

Look at what Google did. They didn't call it the Google app store. They went with Google Marketplace and that's become associated with Google in a very positive way without looking like they're following Apple's lead.

Coming up with something original seems like a no-brainer to me.

OK, here: Microsoft releases a Wavebird controller for their Xbox. It doesn't work on the GameCube, only the Xbox. And no, the GameCube is not a car.

a controller is not a store.

Here's a though - just give up an analogy. I'm not sure what you're even trying to prove anyway unless you think Apple should have continued with their lawsuit and Amazon shouldn't be allowed to use App Store? Even if you think that's true - it doesn't matter a hill of beans. The issue has been resolved.

Because the quote equates futile and senseless legal actions with an early emotionally developmental level of personal potency and masculinity. As in... real men don't back away from a fight, no matter how senseless.
