Copyright law needs to be radically changed to favor the consumer, otherwise we'll be subject to a complete lack of innovation and a technological regression for all society.

Umm... Except for the part where this is going to force innovation. Now Samsung and Google need to either license Apple's specific patents or they need to find their own way and make their own features.

I would love to see Apple license the IOS to Samsung. That might sink the entire Andriod ship.
Good.

Steve Jobs referring to the iPhone at its announcement in 2007:
"And boy have we patented it!"

Samsung (and competitors) were forewarned.

I hear those Saturday's are huge trading days. :D

It was up big in after hours though, so one would expect Monday to see it up.

Samsung stock is most likely in for a beating on Monday in Seoul when thir markets open up.:D

Fewer choices? Between what? The iPhone and the other "iPhones"? Maybe now the market will see more real choices because all that exists in the smartphone and tablet market right now is Steve Jobs' vision and cheap knockoffs of it.

I am an apple fan. The only samsung product I own is a smart tv.

Apple has the right to file and win this case. But a billion dollars! Whew! That's a lot of money to punish a copy cat.

I don't know the details of the patents that have been copied. Just hope its not overboard like the rectangle stuff. And I am sure, the jury wouldn't decide on simply that. It must be a specific design that patent approvers will approve not just being a rectangle :)

This doesn't make sense to me. Because companies like Samsung and Google cannot use these patents, will it not lead to more innovation, and more choices?

Will this not force these companies to find different ways of implementing the general concepts that Apple's specific patents cover?
EXACTLY. This is a win for everyone. Make your own phone, stop ripping off Apple.

Usain Bolt is going to win anyway, so let us allow other sprinters doping. Anyway, the game would look more thrilling and entertaining

I love Apple

but as a self-interested consumer

I think we benefit from this stealing, copying etc.
Instead, the lawyers are the big winners.

Apple could still dominate and crush samsung without winning the court battle
Put those time, dollars, and values into defeating everyone even further

^Spoken as a selfish new iphone buyer Sept 21 (expected)

Hopefully this is the beginning of the end for Samsung. Throw all their execs in jail.

question

"It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners,"

was this part of the verdict?

Samsung:"this will lead to less innovation"!!

ARE YOU STUPID???? It will lead to MORE innovation, not less. It means you cannot copy someone else therefore you will invent your own product not just wait for apple to release something and copy it. I mean look at those new Samsung stores, they are exact replicas of the Apple stores and they have the nerve to get mad that they lost?? They should be happy it wasn't more patents they infringed upon which would mean more money paid to Apple!!

Good job apple and keep suing to keep you unique!!

Okay y'all! It's time to tell any friends/family you know with Samsung phones that they own stolen goods. :)

I would say that Samsung is sad and clueless, but they know exactly wha they are doing.

This further solidifies why I'll be purchasing a Samsung Galaxy Nexus as my next mobile device of choice.

Copyright law needs to be radically changed to favor the consumer, otherwise we'll be subject to a complete lack of innovation and a technological regression for all society.

Complete lack of innovation? How so? Or do you mean a complete lack of copying another company's work?

Look...before I get flamed - I've said this before: if Apple has done some copying then those companies should go after them too. This is not from a fanboi point of view.

Samsung didn't innovate or create - they copied. For crying out loud, there was an internal document at Samsung indicating what they needed to change on their phones and what was the best way to copy - they indicated the iPhone for most of it (forget which post that was in, but it was documented in this trial). Look at the photos of Samsung phones before the iPhone and after. I mean...c'mon...

I'm all for innovation, but direct copying - nope. Make your own is what I say.

I firmly believe that 99.99999% of the posts like yours complaining about Apple winning and wanting an 'open' market for fear of technological regression, would all be reversed if it was YOUR company who did the innovating and was copied. You'd be complaining, arms all up in the air because another company would be making money off YOUR ideas and hard work.

I posted this in a thread last week: a company in Ottawa, Canada invented an adult sex device. Their sales are projected to be near $100 million next year. This device is a new idea to the market and it's very popular.
They're also pursuing the legal route against companies which have since copied their device with knockoffs.

I ask you: how is that any different than Apple vs. Samsung? Should this company lay down (no pun intended) and forsake x amount of millions for 'innovation' and technological progression? "Oh gee...we like our gadget, but golly gee whiz xyz company made one too and they're making millions too. Millions we could put in our coffers for further innovation or whatever we want, but hey, we're all friends so it's ok." ????

Or should they continue their chase to sue these companies because THEY created it, THEY worked hard to bring this product to market, THEY have a vested interest in protecting their shareholders' interests?

I don't understand how it gets any more difficult....

Or, PAY to use the patent.

Cheers,
keebler

This is an excellent point! Even if one disagrees with Apple's case or the verdict, it's undeniable that Samsung chose to walk into a death-trap. There are countless decisions they could've made differently if they weren't pretending Steve hadn't said that.

Its broke but...

I do think the patent system is broken, but the rules that exist today that if you do not patent something then it will be ripped off, and if you do not defend your patent then the courts will say the patent you hold is invalid, not that you waited until it went to far.

We need the patent system fixed.

I do not blame Apple and I do think that even Apple would not have sued if Samsung had not taken the "rip off" to far. Apple did try and reach out but as the internal memo's showed Samsung could not have cared less. The attitude was and still is that there are no rules, laws or patents in order to stop Apple from dominating as they did with the Ipod.

Samsung is even trying to mislead the public by emphasizing the patent of round corners, so that some not so smart people would think: woo, all Apple's patents are like this!

[Edit] FrogsterDude says it well:

Although I do believe a few of Apple's patent claims were valid, the rest were just BS and completely unwarranted Seriously, a patent on a rectangle? Come on.

Well it is going to be pretty hard to make a smartphone that isn't a rounded rectangle, but it can be done. Other companies have started to shift away from the rounded rectangle style. Now of course if Apple goes after the whole idea of just a "rectangle" which seems like a possibility after this successful verdict then things become much tougher for the other companies.

You have to remember if Apple is successful going forward this could be huge. This could just about wipe out the competition and when that happens Apple will own almost the whole market through default.

Of course other companies could make oval or square shaped phones either without a touchscreen or a very limited touchscreen, but they wouldn't sell very well and Apple would still own everything. You think they are profitable now... lol :)
