You mean the little guy doesn’t have enough creative attorneys and lobbying like Apple does.Apple has no choice here. If they don’t defend their trademark they will lose it. That’s the law. All these people upset the Apple is picking on the little guy don’t understand the law. Letting someone use your trademark is like letting someone squat on your land till they own it
Well said. The big bully is trying to get attention here. They should worry about their antitrust practices.A quick google of this Georgette Arcus bottled water (which came up with nothing) suggests to me that this is a publicity stunt. As far as I can tell this bottled water doesn't even exist yet. I smell tactics.
No I mean the law says that if you don’t defend your trademark you lose it. It doesn’t matter how many creative attorneys you have. Of course Apple has more attorneys because they have more money but that doesn’t mean they should let people steal their property. That’s like saying if someone’s rich I should be able to steal their car because that’s nothing to them. They could buy a new car with their spare change and I need a car.You mean the little guy doesn’t have enough creative attorneys and lobbying like Apple does.
Yeah they probably don’t expect to win but they can say they have a history of defending the trademark. This will help them in the future if someone tries to make a computer with the Apple logoI say its a valid claim, however Apple did in fact steal their idea from an apple, so any apple design will be similar.
Also I wouldn't pick up a bottle of water with this label on it, and confuse it with a computer.
Again having said that, the overlay is pretty telling - looks like they grabbed an Apple logo vector and just added bits another leaf and removed the bite.
No because planting a tree has nothing to do with a trademark. So if Apple plants an apple tree and then sells the apple in the cafeteria on Apple Campus, can it sue every Apple farmer out there that uses a logo of an apple?
I wouldn’t called it a random Apple. The similarities on this one are pretty obvious. They sued Pear, now they found a random apple, time to tell them about Newton and his apple.
Apple doesn't own the rights to an apple, just to something trying to ape their logo. That's extreme hyperbole to refer to this as dystopian....I realise Apple has to do this (trademarks require active protection to prevent their loss) - but megacorps owning the rights and trade dress to everyday objects is terrible for human freedom.
Welcome to the dystopian future - brought to you Coca-Cola, Apple, amazon, and OmniCorp...
Yeah, that quote goes way over your head.Great artists steal.
Agreed, it totally makes sense. I wasn't aware of that until I read it somewhere up in the comments that you have to defend your trademark.Yeah they probably don’t expect to win but they can say they have a history of defending the trademark. This will help them in the future if someone tries to make a computer with the Apple logo

Wow, yeah, the random design elements on top of the logo really distract from how similar the silhouettes are.
Having built a few logos in my day, this is insulting. Sloppy. Amateur. Whomever designed that logo, 100% used Apple’s logo as its base. Obviously. I can’t imagine they’re feeling too good right now. Nor should they.
On the bright side, you get what you pay for. Hire, and pay, real talent when developing your brand. Thanks.
Not saying Apple doesn't have a case here. But I think there are also only so many ways for an apple icon:![]()
