Wow... Apple's paying the billions left and right.

If they continue this way they'll be bankrupt pretty soon.

Not even close, the new iPhone is around the corner and will be flushing in tens of billions $$$ of new cash to play with

Although it's not clear, there's a simple explanation. Nokia could have received the payment from Apple but only applied part of it to their books this quarter and will apply the remaining portion in subsequent quarter(s). That would help to avoid a precipitous drop next year in YoY comparisons. Not saying that's what they did or that's the reason, but it's an easy explanation that could make sense.

Makes sense.

Hopefully recent events of Apple getting busted for stealing other people's innovations, puts an end to the delusional thinking Apple is the only one that innovates and everyone steals and copies from Apple. These two recent decisions against Apple destroy what Sammy was ordered to pay up. Dang. Time to turn off the photocopiers Apple.

Yes it was just about rectangle, grid of icons and slide to unlock which btw apple stole from neonode and called its own. Considering that apple copied or followed others a lot recently (folder, notification shade, big screen, widget, bezel less etc.

We are talking about pure copy/paste by Samsung to the point of people getting confused and not knowing which is which and not some shades/folders or whatever. And please...give us a break! Since when were sizes an invention? Correct me if I am wrong but Apple have done computers on different sizes, iPods on a different sizes, what on earth would have stoped Apple do do the same with iPhones?? Ohhh... I forgot! Sizes were copyrighted by Samsung.
And bezzeles? Now that is copyrighted also? These are signs of technology advancements were before it was not possible to do it due to limitations and now it is. Sooner or latter all devices will be like that because there is no need to have these thick bezels.

Why is it pure copy when everything already existed before? Grid of icons already there since win3.1 and symbian. Since when was rectangle shape an invention Neonode used slide to unlock years before apple. Samsung used plastic and elongated button. Apple didn't. Samsung has its big logo in front, so how confusing can that be?

Just ask yourself about any business... what's the goal? Optimize for profit, or help the customer? Clearly business are supposed to optimize for profit.

Profit is one goal, yes. Businesses also have the choice of taking the high road or the low road with regards to other's IP, and of emphasizing environment, employees, community, country.

Apple alleged that Nokia was charging too much.

Of course they did. Apple's lawyers ALWAYS claim that Apple is being charged too much. And therefore, then the rate "isn't FRAND". (Apparently it's only FRAND if Apple likes the price :D)

If anything, Apple probably ends up paying less than anyone else... which is pretty discriminatory.

That said, if Nokia was giving patents to PAEs who were increasing prices, then Apple has a point.

This $2 billion payment is not punitive damages being awarded to Nokia. Presumably it is Apple paying the back royalties they owed Nokia.

We don't know what the money is for, as it's a private settlement.

Interestingly, Apple made the same accusations about five years ago, and in 2011 also ended up settling with Nokia for a couple of billion in upfront and future royalty payments.

I think it's easy to predict what will happen around 2022.

I haven't kept up with how much they've paid out recently, but for them putting another $5-$10 billion ontop of their $250+ billion cash pile, I don't know if they're honestly worried. I do sometimes think they intentionally have been taking advantage of what they can in patents and avoiding legal fees, taxes, etc. (legally of course) - and knowing that they hoard cash for the day that all changes. So in this case, planned or not, it's easy for them to write out the $1.7billion. I was honestly surprised it wasn't the full amount, unless they with-held the remaining $300million to ensure all agreements are met (would make sense to do so). Good faith payment up front and you get the rest when you hold up your end of the bargain kind of thing.

Karma.. there was a period when no one was filing a lawsuit for patent infringement for mobile devices.
then apple started the infamous patent war and now it looks like apple is getting back some.

Yup, been saying that for a while now. It was just Apple drunk on power and greed when they opened that can of worms.

So, in this case, as I understand it, Apple wasn't "stealing" anything. The patents in question were essential for implementing the standard (in this case, wi-fi, I believe). You can't implement the standard without using the patent and there's no way around it. By law, companies holding these kinds of patents are required to charge "fair and reasonable" royalty rates. They are not supposed to charge one company more than another. The term here is "FRAND," "Fair, Reasonable, and Non-Discriminatory."

Apple alleged that Nokia was charging too much. They were never arguing that they shouldn't have to pay anything, just that they were being asked to pay too much. So, they were withholding payment until the terms offered were acceptable to them. Nokia didn't agree, so Apple sued them. Nokia countersued Apple. (or Nokia sued first and Apple countersued. I'm not sure which). Eventually it led to a settlement between the two companies, mainly because if the suits went to trial, it could have ended up even more expensive for either or both parties. This $2 billion payment is not punitive damages being awarded to Nokia. Presumably it is Apple paying the back royalties they owed Nokia.

I fail to see how this is "stealing," in the context of this particular case.

Well, first, no. FRAND doesn't mean everyone pays the same rates. Every licensee's terms and rates are different because they have different sale volume, duration, cross-license, etc. Apple's problem is that they believe while their frivolous patents (eg, rounded-cornerd, slide-to-unlock) are worth as much as $6~ per patent, everyone else's, especially SEPs, are worth $0.000000x. So it's not surprising that Apple thinks Nokia's too much. Apple thinks they should pay close to nothing for Nokia's patents.

That's usually how Apple squeezes their suppliers, by making tons of baseless accusations without any evidence, then withholding payment, then taking them to court. It settles before it goes to jury trial when it looks like the public is picking up their BS or discovery may reveal something embarrassing.

is this why Apple waits years after it's available to implement newer phone tech and other os features so people will think apple invented it?

Qualcomm should just point to this case to demonstrate Apple's modus operandi is to low ball or avoid paying altogether and pray they don't lose in court.

Good artists create.
Great artists steal.
-Steve Jobs, quoting someone else...

I guess this is paying Microsoft back after the cash infusion they got back in the 90's.

Yet, Jobs wanted to go thermonuclear war on Android for stealing.

"I'm going to destroy Android, because it's a stolen product. I'm willing to go thermonuclear war on this." Steve Jobs

champ you saw right through me. You were in hyperbole mode so I wanted to find out exactly who, what or where was exhibiting delusional thinking.

Yep, by claiming money that's rightly theirs.

Nokia claimed more than the FRAND agreement, i don't know if they got that.

Interesting as it looks on the outside Apple blatantly ripped off Nokia patents. Amazing how many lawsuits Apple are involved. Sometimes it makes you question exactly what Apple have invented.

Just so you know. Apple had a FRAND licence with Nokia for patents together with several others, Apple didn't invent GSM etc. so they have to pay for it. The dispute was on how Nokia tried to get more money via external patent holding companies according to Apple.
