Finish the quoted senence.
There is still not a gotcha there, as while they follow majority of cases (operative word majority and not all) it is still non-binding and I assume that the person making the recommendation does it after much deliberation and presents those deliberation instead of "hurr-durr, apple pay big now."

I'm clearly not a lawyer but had never heard of it working that way. I thought it was the other way around. The Attorney General can make all the recommendations they want, but once the Supreme Court says it, the only way around it is legislation. At least, that's what that piece of paper on the steps told me in song form so many years ago.
You hate on our court despite not even understanding it. Ironic.

Of course the advocate-general has no power to decide anything but the Court of Justice (akin to SCOTUS in matters of Union law) will consider his arguments.

Wait a minute wtf. The equivalent of the attorney general can just say a court decided incorrectly and that’s it, it gets overturned? How is that democratic?

No, that's not quite it. As others have noted, this was an opinion and not a formal ruling as opinions by advocates-general are non-binding. The actual ruling/decision by the European Court of Justice isn't expected until next year. All of this was explained in the article.

Is anyone surprised? The EU is one step short of communism with their blatant subjective promulgation against anything that appears to be success.

The corrupt lawmakers see money and think “hey, we should decide what they do with it…let’s take it!”

The EU is becoming so crazy that it may be best, financially, for Apple to just sunset the market entirely. Let’s see how long the EU will keep this up once Apple starts closing stores.
Many Europeans have either lived in a then-communist country or only a few hundred km from the border of one and yet Americans, who basically are on the other side of the planet continue to lecture us as to what communism is. No thanks, we certainly have more experience than you.

It's about Ireland giving illegal state aid or not. It isn't about Apple illegally avoiding paying tax in Ireland.

It'a reason why it's called "Commision v Ireland and Others".
lol. Apple would have KNOWN they were circumventing the rules. KNOWN!!!
When Joe Public gets arrested and says he didn't know what he was doing was illegal, what is he first told?
Ignorance of the law is no defence.

Alternatively, they could accommodate their customers and lower Tim's salary.
Win, Win, Except for Tim!

Lowering or even eliminating Tim Cook's salary/compensation would hardly make a difference. Cook made around $100 million (USD) in salary, stock, bonus, etc. last year. Apple sold around 230 million iPhones last year. If that $100 million (USD) was used to lower the price of each of those iPhones, it would come to an average of around 44 cents (USD) per phone and that's just iPhone sales. Factor in Mac sales, iPad sales, Watch sales, subscriptions, etc. and the average customer would save even less than that. Big picture, reducing or eliminating Tim's compensation (as large as it is) would have practically no impact on product pricing.

If that's what it takes to get multinational corporations to pay their taxes, so be it.

I'm huge Apple fan. I've been buying Macs since the 1980s, iPhones since 2007, and I've had a few iPads as well. My next purchase in each of these categories will be from Apple, but none of that means I'm in favor of any corporation paying a lower tax rate than working people, as happens far too often.
Care to back that up with some facts?

No big deal.

They’ll just add an extra 50 bucks on every new iPhone next year.
Instead of 999.00 you’ll see more of 1,049.00 and such prices.

Bottom line: in the end we pay for every one of Apple’s screw-ups. Be it this or anything else.

I am not sure how you got the idea that an advocate general is anything like an attorney general?

An attorney general works for a government as its legal advisor.

An advocate general works for a court and is barred from working in an administrative or political position for a government or similar authority. Within the European courts they need special permission from the court to take on any external work.

A very rough comparison would be to equate an advocate general with a clerk to a Supreme Court judge.

The advocate generals are national judges or senior lawyers, and cases before the ECJ and cases are assigned to them to consider the case and write a report. In the lower court General Court a judge can also act as an advocate general.

Their opinion is non-binding because they are not the judges on the case, but they are influential because they prepare the case, research the law, and present conclusions. It is uncommon for their opinions to be rejected completely and usually when not fully accepted it will only be a minor disagreement over legal interpretations rather than issues involving matters of fact.

Apple complied with Irish tax laws so it is legal.

Europe has a lot of nerves telling other countries that their laws are “illegal”.

You know it is called European Union for a fact, together with encompassing laws that members have to follow and abide by. Heck even in my country laws had to be amended as they ran afould of laws of the ones of the European Unions.

What kind of democracy is that? You vote for a government which hopefully creates laws that you approve off, only for some European entity who you did not vote for declare it is illegal, because the European Union wants a monopoly on tax revenue.

And now this European Union goes after companies for following the law?

Pro res log gave us the USB-C not the EU and the benefits of it are for the 5% of Apple users, for the rest of us it just means changing existing cables 😏
Yeah… I’m sure Apple planned to splinter off a new iPhone model with USB-C while the newer phones with Lightning. 🙄. EU brought USB-C to iPhone.

I haven’t used USB-C for data even once for my iPhone 15 Pro, and I never planned to. The benefit for me was getting rid of existing charging cables, since I had both Lightning and USB-C in multiple spots. One cable is bliss, and it could/should have been this way 5+ years ago.

Wow, just wow...

A good one actually. So the European Union are not kind of despots, the European Parliament, a legaslative body of the EU, consists of represantives of member states. So those are voted in...

How do you think the legaslative body of the EU is formed? By Musical Chairs?

But what if something better comes along? Are we going to wait for the EU to sign off on it?
Silly argument. Is there a new port on the horizon? Is anybody asking for a new port? Is there something limiting about USB-C that an updated port would alleviate?

USB-C isn’t going anywhere in the next two decades, if ever. If anything, wireless tech will take its place.

Apple will just add it to the prices of devices and services. We will be paying this bill.
Exactly this. And EU cannot practically punish Apple for this practice either.

Nah, add eddy and Craig, among other top leadership to the mix.
They ALL SHALL SUFFER!
