I just can't imagine what I'd be sued for if I started up a company that sold in America.

Though, it would be funny to see somebody suing a lawyer because that lawyer made him lose his/her lawsuit.
 
Me thinks these folks have been sitting out in the sun too long.

I have owned an iPad since day 1, and I have never experienced issues with overheating. Stuck pixels and wifi issues, I have had. I just think some of these people are trying to make a quick buck.

So you get a sun burn by sitting in direct sunlight for hours on end? If you do, you should be more worried about skin cancer.

I fail to see how my skin conditions have anything to do with this topic.

I assume that you are not in "direct" sunlight but under a sun umbrella.

Actually, I go to the beach to tan. I sit in the sun to accomplish this. I read while I do this. I see overheating resulting from this? Apparently.

Anyway, as other people have pointed out, the operating specs are the same for both the kindle and iPad. The main difference is that the iPad has a black bezel which can cause it to heat up if you leave it in the sun.

Well isn't the bezel a design flaw if it causes overheating? How can I read my Ebooks if a silly bezel makes my awesome $500 "revolutionary" device overheat in sunlight?
 
I've seen people using it on sunny days in Apple's ads. That creates the reasonable expectation that the device will work in those conditions despite the fine print in the package.

Yeah and sometimes it shows it working without the charging cord, creating the "reasonable expectation" that the battery never needs charging.

Is there a thermometer in those ads? You keep referencing these ads like they mean something; they're irrelevant. Believe it or not, many people enjoy summertime temperatures of 75-80°F. Like most of the top half of the nation, 150 million people or so. I routinely sit with the iPad for hours in temps in the 80's without incident. What's reasonable to expect is that you understand that the manufacturer's specifications for use are to be followed or you risk the consequences, however temporary and immaterial they may be.

I've had the warning once in 95° Hilton Head, and it came back to life in a couple of minutes. Good luck demonstrating damages, counselor.
 
This should be thrown out. It seems like a frivolous lawsuit. Just another idiot out to get money. I mean come on, do these people actually want an exploding iPad? Did they ever think about this as a safety precaution?

These iPad's have two big batteries, which give these users a lot of battery life, but can over heat. Something tells me these people suing, need a lesson on Batteries, or at least need to read the Caution label of a battery.

I use my iPad in the sun all the time, never had a problem. I am right now and it is 97 here in Bakersfield Ca. I call BS.
 
I agree with this suit 100%. But, on another note, I also enjoy creating drawings with my own poop, and once accidentally bit off my own finger, so perhaps I am wrong.
 
Um lets see, a black screen in direct sun when its 90+ degrees. I think it should have its own fan/ liquid coolant system and last for 1000 hours. I also want it 20% thinner.

Carry more of that water.

Ipads should work everywhere that you would encounter during normal use. Using it outside on a warm day shouldn't be an issue, unless its poorly designed.

Apple lists the iPad's operating temperature as 32° to 95° F (0° to 35° C), so it's not hard to see that using it out in the hot sun can quickly heat up the device over the maximum temperature.

Perhaps re-worded to '...does not live up to greedy lawyers expectations for revenue harvesting on behalf of greedy plaintiffs whom hide behind privacy laws..."

"...reading on the iPad is just like reading a book." "....the sunlight or other normal environmental conditions"

Hmm.... How many electronic devices can be taken into the hot summer sun and not cook the circuit boards...
Lawyers don't work on common sense.. they work on fee collection for case fabrication..... So I guess the over paid lawyers can see this as another attempt of fee harvesting from the consumer device markets... It's not about common sense.. AKA don't take your electronic device into direct sun... and the temperature of hot daytime sun is obviously above the prescribed operational range...

So will Kindle overheat out in the sun for burnt lawyer offerings...? ...or perhaps take the OLED devices into hot sunlight coals and watch them fry.. but where's the plaintiffs against those device manufacturers... for them not being usable in hot daylight sun, let alone overheating when used...
 
I've had the warning once, when I left the iPad flat on a table in direct sunlight. I'd guess that if you're using your iPad generally you're holding it upright so less sunlight hits the screen.
 
Oh have a cry there the dumb ass who left it in the sun, Mines never hot ever I'm always going on how cold it is.
People are just stupid and think they can take Apple out
 
I'm gonna start a class action against Sony, Canon, and every other Video Camera manufacturer that has a dew sensor. When I go from a humid environment to a hot one the camera stops working until the moisture has gone

Oh sweet Jesus merciful - you do realise that the cabin pressure is pressurised? Please, people like you are the reason why the US is in the economic, political and foreign policy clusterf-ck that it is in.

I don't see Dairy Queen advertising their ice cream as able to be used under the sun for a long period of time :rolleyes:

Also, most people know that ice cream melts, so you don't have that reasonable expectation. And other devices work in the sun, and Apple advertises with users using the iPad in the sun. So the reasonable expectation is that you can use it normally in the sun, despite whatever fine print.

Yeah, but I see people eating those ice creams in the sun! that must mean I can have it sitting in the sun all day without it melting! see how bloody stupid that sounds compared to the idiots trying to draw a line between casual use in the sun versus extended long use in the sun?

btw, where in the ad have they used it in direct sunlight?

A quick glance at the location of posters on this thread shows a rough correlation:
- those from higher latitudes (Seattle, Canada, South Africa, etc.) are sympathetic to the suit
- those from lower latitudes (Georgia, Texas, California, etc.) think the suit is absurd.

South Africa is as far north as Canada is?
 
Actually cabin pressure is 8000ft not sea level otherwise the plane could not fly at 35000 feet as it would explode. 8000 feet is a trade off between what a human can stand and what a plane can stand !!!

The cabin pressure depends on flying altitude, temperature and aircraft type / specifications – the A380 flying at 40,000ft is leveled to 5000ft [above sea level] which is much better than a regular 747. And at 20000ft it's only about half of it.
 
Um.. doesn't it say not to use it for prolonged periods in direct sunlight?? Let alone how you could see anything on the screen anyway ;)
