I have to admit some of these analogies about keyboards and the mouse do Samsung's case no justice.
 
I give apple credit with some very innovative ideas, but what kind of patent did samsung infringe upon?

The only info so far is that a judge in Dusseldorf decided on behalf of all of the EU that parts of Samsung's design (e.g packaging) could later be determined to copy Apple's EU-registered designs. Thus a preliminary injunction was issued.

(Apparently actual patents -- not design registrations -- are still decided per country.)

Samsung was not notified or given a chance for defense before the injunction was made. Their appeal will be heard in about a month by the same judge.

Some EU reporters think that Samsung will need only make a few relatively minor UI and packaging changes.

Basically, it seems to be a delaying tactic by Apple to pause Samsung sales while they mount more refined attack vectors.

Last time I checked, Apple didn't invent the tablet. So please quit saying things like "they stole Apple's design" when in fact I'm fairly sure the patents in question refer to UI elements.

Don't get me wrong, I like a lot of Apple products but I dislike their policy and all of this patent BS. Wasn't trolling guys. And you can't prove that I'm wrong because as I said. It's just a theory.

You really can't figure it out? If you're that blind to why people would be upset at your post (all the multiple reasons), then perhaps you need to take a step back and think about what you're really saying. Or perhaps you really are trolling and now you're trying to play the "I didn't know it would be so upsetting" card, though I'm not really getting that vibe right at the moment.

Hint: It might perhaps interest you to know that most people don't care for the term "fanboy", or at least the negative connotation in which it was used. That's a big part of one reason why I might have voted your post down had I seen it at the time (I have no interest in tracking it down now to do so). It's far from the only reason, of course.

The term is used to describe a Fanatic Fan of a product. We have all heard it and I wasn't using the term to insult anyone. My point is that those people exist and we should find out what kind of computer the Judge uses and what his personal views are. I think there is some real bias if not corruption going on because this is insane. The Shape and design are completely different !

No, innovation like the fact that your Android phone would look like this were it not for Apple, and instead looks more like this, which in turn looks a lot like this. See a pattern?

Things like the camera shutter button and the notification system are minor implications.

Must admire how the fanboys blindly defend anything that apple does. Anything the other componies supposedly copied is bad for innovation and if apple copies, it's a minor thing.

What I think is the low ball move by apple is to wait until right before launch to get the injunction and not even give samsung a chance defend itself. Apple knew about it long before now and just now they are doing it. That to me would be grounds that they should of not been granted it but the system is pretty messed up.

I do stand by what I said that if it is over turn Apple should pay Samsung any loss revenue and cost for it being pulled along with some more on top of that.

The biggest issue in Apple's suit has to do with "trade dress", which is patented. As much as all cars today look very similar is not a problem, however each car has unique identifying features that set them apart. In Samsung's case, they even copied Apple's icons right down to the colors used. As another analogy, a student plagiarizes an article, changing a word here or there and moving some text blocks around. It's not an exact copy but it is still is a theft because the work done was not their own. That's what Samsung got caught doing.

There were a lot of "trade dress" patents that Samsung infringed upon that his decision to apply an injunction wasn't all the difficult. Injunctions are very difficult to get applied and speed is important to avoid further damage to the patent holder, Samsung will get a chance to argue their point if it goes to a trial phase. However, they are in a very weak position, or the injunction would have never happened.

It may only take minor changes but Samsung will have to be original this time around...no more plagiarizing someone else's designs. Did you know that Samsung even knocked off how Apple packs their iPad and how the outside of the box looks?

It is that as you say, but it is also much more. If Samsung has to go back to the drawing board and be original for a change, and that takes time, so be it. They should have done it that way the first time around.

If someone is counterfeiting a product (which is what this nearly is) then the legal first step is to stop the distribution of the illegal product and then punish the offender. This will cost Samsung a lot more than just a delayed product launch, there will most likely be other penalties.

No, I think the Xoom should remain in the stores as a stinking rotting reminder of how bad someone can make a rushed attempt to grab some market share at the expense of the consumer.

IU elements AND trade dress. I like Samsung products in general. However, in this case, I believe they were of the mind "we're too big to prevail over."

I am a big android fan but even I am going to say come on here that is a bogus argument.

I mean by that argument Windows does more updates than OSX. Number system is a numbering system. Android next update is 4.0 coming in October called Ice-cream. The 2.x line yeah those were pretty big updates going 2.0, 2.1, 2,2 and 2.3 but 2.3.2, 3& 4 not so much.
Honey comb 3.1 and 3.2 were just that minor updates to honeycomb.

I mean comeon, all tablets, up to and including the iPad, are basically one big square with a screen on it. There's nothing particularly fancy about them. Apples genius wasn't in inventing the form factor, it was from making said form factor sleek and ergonomic enough that people would want to use it.

It's a good thing there are knock offs and other brands that copy the initial design then run with it. It's how you see improvements made. Otherwise, it'd be like if Ford had an exclusive to the assembly line and the concept of a self propelled vehicle with four wheels and a steering column. We'd only be driving slightly updated versions of the same Model T 103 years later.

No tablet looked like the iPad before the iPad so clearly it is possible to make them look different.
