While I think there is a larger issue and that the lawsuit is not needed in the end. The point of the arguments to me seem reasonable. Considering that the from the Apple view point that the lease / purchase plan in a binding contract and that non-payment or other types of default would have some level of financial impact on the both parties. Apple should respond to the issues immediately.

I would expect the Judge to ask Apple if there is a plan to remedy the issue and if acceptable and reasonable the judge will put this on hold to see if the issue is resolved. At this point I think that Apple is just being forced to move this issue up in a list of priorities.

As far as the law firm, I hope they manage this for free. Especially if the root / main person complaining is in any way connected to the law firm.

Apple has more money. People think more money sitting around is more to gain.

Billions of dollars is billions of dollars....sure apple has more but what does it matter when its billions? What exactly is the damage here? They didn't their their phones sooner??? At least with Samsung its more of a good case.

There is no damage as of yet. As I've said this is extremely stupid. Now if people are out the 13th payment starting September 26th. Then they have a case. But not a Class action lawsuit. Apple should just refund the 13th payment or compensate the customer. But right now there are literally ZERO in damages.

No one has paid 13. The 13th payment wouldn't start until September 26th at the earliest. I signed up launch day, which was 9/25/15 and my monthly payments started out on 9/28/15. Still 16 days away.
Yes but the lawsuit didn't indicated which one. It could of been the 6, not 6s. Folks on this site jump to conclusions and know nothing about the background of this claim and the law.
 
Meanwhile Samsung Note 7's are catching fire somewhere. Or better yet 2 million people are being told to stop using their devices.

I'm a Apple user but boy there are some cry babies out there willing to sue for every small detail.

I'm ... confused by this. I'm an IUP customer and I do have a phone on hold for me at the local store for Friday.

What exactly are the stores expected to do once they've run out of the phones set aside for the upgrade program? When a store is sold out of something, it is sold out. they can't just conjure more product from thin air. If I complain about the lack of product, I'll just get laughed at and told that the product just doesn't grow on trees and to come back later when there's stock.


Upgrade folks were limited to a particular store's inventory. In the past, one had a shot at the entire inventory with an option of where to ship it. And that's a massive difference.

Yikes, some lawyers are a bit too expedient. Give Apple some time to sort out the upgrades. People are going to die with their 6Ses being in their possession for a month or two? Wth?
 
If you are on the program, you will understand the issue.
The promise was that people can get a new iPhone every year. Not every 13 months. It's also a reasonable expectation that the new iPhone described is the model that the customer wants.
People on the program, if they want the black 7 plus, they are not likely going to get it before the 13th payment.
I am on the program, and I kept refreshing since 12:00 on multiple devices. By the time it loads, which was about 12:07, all blacks 7 plus were gone. After browsing for bit more on other devices, I ordered a Jet Black 7 plus, and the delivery date is mid October. I will definitely bring it to Apple and ask them to covert it to my upgrade program.

You said new phone "every year"...but a year from the last iPhone release is September 25th...so technically no one on the IUP program is eligible yet...not even when the 7 actually releases.

There was no upgrade program for the 6. The program is not even 12 months old. First day ever was 9/25/15.
 
I think the problem was no one expected to sign up for this program and be treated second class.

There were tons of people who woke up early on pre-order day and were denied the opportunity that every other purchaser had who also woke up early on pre-order day.

Its not second class, like others have said, first come first serve. Simple supply and demand. I am not familiar with the contract of this upgrade program, but I am confident there is no distinction between someone who is participating in the upgrade program and someone who is not when the time comes to upgrade. America, resume temper tantrums.

They don't even promise it at the one year mark. You have the option to upgrade after 12 payments. The 12th payment was August 26th for those that signed up day one last year. You can upgrade any time after August 26th. That's the only promise you are given and that was fulfilled.
How was that fulfilled? When I tried to upgrade I was told I can't. I would have to come back in a few weeks. Not even allowed to put in an order for shipment or store pickup at a later time.
 
First come, first serve folks. Just because you're already in the upgrade program doesn't give you premium access to a new iPhone every time.

This is a joke, but if you still don't see how Apple dropped the ball on upgraders, you're clearly not informed. It's not a matter of first come, first serve. Upgraders got put into a different line than everyone else with a dramatically smaller supply of options to choose from and no option to get in line for an order like everyone else. It's a colossally different situation than you're suggesting it is.

So? Demand was high and some people will be disappointed. No one was treater like a second class citizen, demands outstripped supply and thus not everyone gets one on Day 1.
 
According to the plan as documented on Apples website, you become eligible after the 12th installment payment to upgrade. It does not stipulate anywhere that you get the upgrade on the first day of availability of a new phone.

No, but the program heavily implies that customers can upgrade annually (12 payments or months). You can definitely argue that there is no guarantee that a customer will be able to get the next phone immediately after that 12th month (hence the "at least 12 payments"), but let's not ignore what the main purpose of the upgrade program is marketed as in the first place.
