Agreed. Apple dropped the ball but it is actively trying to make it right. If I was an iPhone Upgrade Program subscriber, I would be justifiably upset, but I would give them a chance to do the right thing before resorting to class action suit.
Yes but by then you "could" miss on the first batch of iPhones and wait a few months. Time is priceless, I would give 50m just to get back 1 minute back of my life.

I wish we didn't have to go to the Apple Store. My nearest store is 120 miles to the east and to the west. The day before I went to check my eligibility (just in case) and I'm glad that I did. Since I had my iPhone swapped due to Touch ID button overheating and rebooting issues last autumn, they didn't transfer my upgrade eligibility to the replacement device.

I didn't have any issues ordering on launch night, however, I was told by two different Apple reps the day before while dealing with my upgrade issue that upgrading my device on the iPhone Upgrade Program wouldn't require me to visit a store and that I could even "print out a return shipping label for my old device." I emailed Tim Cook over the matter (and another issue with trying to buy an unlocked device for my Grandpa) and late on Friday an Apple rep left me a message saying that she was responding to the message I left for Tim Cook. I have yet to call her back because I've been very busy and also it was the weekend, but I'm not sure what she's going to say, especially since there is now a lawsuit.

It kinda makes some sense though. If you're going to tout your program as "You get a new iPhone every year" then you better have a new iPhone ready for these customers every year who are essentially paying a subscription to always have a new iPhone and AppleCare+. Those people are your best customers. And forcing them to drive 120 miles isn't cool either. Luckily for me I need to return and get some more stuff from Ikea anyway, so it's not a wasted trip.

Are they really the best customers? Because they're filing a lawsuit. They seem like a burden to the company IMO. Plenty of us get the new phones whether year, but we pay full price up front.
 
How was that fulfilled? When I tried to upgrade I was told I can't. I would have to come back in a few weeks. Not even allowed to put in an order for shipment or store pickup at a later time.
Again. They didn't promise you a new phone day one. They promised you the eligibility to upgrade after 12 months. You are eligible. That has been fulfilled. Just because there are no devices doesn't mean they didn't fulfill their requirement. Devices are always short on launch day.
 
consumerism is a brutal thing... I cant believe people are crying over a device... This society is a sick one...
 
Meanwhile Samsung Note 7's are catching fire somewhere. Or better yet 2 million people are being told to stop using their devices.

I'm a Apple user but boy their are some cry babies out their willing to sue for every small detail.
Their really are. But there entitled too they're opinion at the end of the day and there able too sue Apple if that's watt they want too do.
 
As an iUP member, the only part of the lawsuit that I agree with is having apple waive the 12-months of payments requirement for this upcoming iPhone. In order for me to upgrade, I need to have made 12 full payments. If I don't get the 2016 phone until November, then I won't be able to upgrade to the 2017 model until November 2017. If I wanted to get the 2017 model at launch, I would have to pay 12 monthly payments in 11 months

If you are on the program, you will understand the issue.
The promise was that people can get a new iPhone every year. Not every 13 months. It's also a reasonable expectation that the new iPhone described is the model that the customer wants.
People on the program, if they want the black 7 plus, they are not likely going to get it before the 13th payment.
I am on the program, and I kept refreshing since 12:00 on multiple devices. By the time it loads, which was about 12:07, all blacks 7 plus were gone. After browsing for bit more on other devices, I ordered a Jet Black 7 plus, and the delivery date is mid October. I will definitely bring it to Apple and ask them to covert it to my upgrade program.
have you made 12 payments. The first 12 months won't be up until at least the 23rd or the 26th of September. Did you ready terms of the program? Eligible to upgrade after 12 months....

First come, first serve folks. Just because you're already in the upgrade program doesn't give you premium access to a new iPhone every time.

What a massive joke.

While I agree that the lawsuit seems silly, they do have a valid point. They just want Apple to "make all of its iPhone inventory available to upgrade members."

They aren't asking for preferential treatment. They just want the same opportunity that everyone else gets. The upgrade members could ONLY buy phones that were in stock at a physical store, while regular customers could pick from that stock AND the online stock.

If you don't get the iPhone until November, your 12th payment is October 2017, not November.
 
Are you serious? I mean I can understand people being frustrated with the snafu that was trying to pre-order one of these things, but this is just ridiculous. Not unprecedented, it seems a lot of people will try to sue over just about anything these days....
 
I see where they are coming from, although this is a bit quick to be filing the suit. I'm sure Apple was astonished at getting the notice already. They should have gone to Apple first and let them know what they were thinking about doing, and seeing if Apple would do something without involving the courts.
 
Apple has responded to customer frustration and has been collecting customer information to attempt to get customers their iPhones as soon as possible.

Unbelievable. I'm willing to bet that this law firm went out looking for "victims" with the goal of pocketing millions. The lawyers aren't the true problem. It's the judges that grant class action status and allow the sharks to pocket unseemly amounts for often trivial reasons.

In this instance, Apple is trying to correct the problem. Not every upgrader was harmed (can't believe I just typed that BS) and again, Apple is trying to rectify the situation.

Whining is the new American pastime.

I think you're missing the point. Stating I'm eligible and allowing me to order are two different things. At 12:10am Friday morning, if I was online just like someone else not in the Upgrade Program trying to reserve a phone, shouldn't I have just as much of a chance to reserve a phone. Any phone, any color. If what i wanted was sold out, shouldn't I have had an option to reserve a phone for 2 months, 3 months from now. Whenever. That was not the case.
 
Oh well, I guess these lawyers were p*****d they couldn't get the iphones they wanted either? It's the only explanation I can think of for such a stupid law suite.

We can't bring water to children in third world country's but BY GOD I'll pre order the iPhone I want, or sue Apple!!!!!
 
Wow, really, hey Apple I'm suing you to make all your phones available on your website plus pay me back my 60-80 bucks back cause I had to wait for a new iPhone. While we pay this lawyer 2500 for doing this work for us....Just plain ol DUMB!!!
 
I am part of the program and I think this lawsuit is stupid. I am also part of the program from day one. Apple has never once said being part of the program gaurentees you a new device on launch day the next year. Plain and simple as that.

No, but they also didn't tell you that it would become MORE complicated to get a new phone on launch day and that you couldn't order with the rest of the world. You're essentially pushed to the BACK of the line for a new phone but that's not the way the program was sold to us. Not that I think a law suit is necessary, Apple obviously sees the flaw here and is trying to fix it.
 
How about you check your facts before throwing insults around. The point people are making is that IUP customers were not given an EQUAL chance to pre-order an iPhone 7. By the time the website stopped freaking out, all local stock had been purchased by people who chose pick-up delivery. THAT'S not fair and that's what people are upset about.
Correct. I think these folks are just kids that don't read to understand, they read to insult.
