Way too confusing ...

The third party company (Anymode) that makes the covers is privately held and the CEO is the nephew of the Samsung chairman and CEO. The parent company of Anymode is Youngbo engineering, who's CEO is also the CEO of Samsung himself ...

Basically it's these are all companies spun off and owned by the Samsung family (meant to overcome legalities??)

If they are going after Samsung, it's not over these cases.

Anyway, even the title of this article is wrong, Apple have not brought suit against Samsung over this, they have just sent them notice.

Confusing ownership, corporate relationships, and jurisdiction shopping is used to avoid results of lawsuits and even criminal actions. It should not surprise anyone it is a layer in obvious IP infringement. The fact is infringement itself can be proven and with civil litigation all parties either at fault or legally negligent are jointly and severally liable for the entire infringement.

So this tactic has legs.

Steve said it quite simply. Don't copy us. Invent your own stuff and we will let the marketplace sort it out. It turns out that is not the option Apple's largest competitors select. Therefore it is morally and legally correct for Apple to spend under 0.5% of its revenue on legal actions to recover over 2%.

And to clarify in the mind of the public who owns what and what ethical people should themselves buy. Ethics does still matter to some. Shocking in 2011.

Apple wears their desperation on their sleeve. They know the iPad - particularly with the slow and cumbersome iOS5 - has seen its best day. My iPad 1 was basically rendered useless after the iOS5 "upgrade" but instead of taking Apple's bait to get a faster iPad 2 I'm going to make the switch over to an Android-based "pad".

Apple has overplayed their hand. Now their strategy is to try to sue their way to greatness? How about competing??

they should be suing Anymode... but then again... should they be suing anyone? That is, what was the infringement (it hasn't been filed yet)

At first glance, you didn't read the article it seems. Those cases are made by a company called Anymode.

Right - just like the article yesterday stated there was a "ban" on HTC phones. There's no ban (yet). In April there will be a ban.

Is the "Not Apple" picture an iPad? I am not being snide here, I am just unsure if this is a picture of the Samsung case and tablet or another case for the iPad.
It is an iPad with a 3rd party case that folds like Apple's Smart Covers.

We don't know what Apple's claims are, they haven't filed a lawsuit and notices aren't public. We don't know what product this is referencing and we don't know what IP Apple holds that could make that product infringe on their portfolio.

Basically, this is a big flamebait article.

I don't think it's lazy... I think (my opinion only) it's intentional. They want to create iPad-like accessories for their tablets so they just get an affiliate to do it... Question is, is it legal? There's lots of knock-off products on the market, how is this different?

Only a notice has been filed so far, so it's all speculation.
 
I believe if you buy a Samsung tablet mail order then it will come delivered in a brown cardboard shipping box.

Amazingly the same colour and type of brown carboard box that Apple uses..

It's different in that it's not a Samsung accessory.
 
This is the same as fighting counterfeiting. If I had a well-known brand and an Asian company were selling counterfeits of it, I would fight for my brand as well.
 
Next they'll sue Samsung because they are from Korea and Korea has an A and E in it and Apple has those letters patented.

Every company blatantly tries to copy Apple in every way. I can see why they would but come on, if it ain't an Apple, it ain't an apple and I know where my loyalties lie!

And why shouldn't Apple try and sue all the copycat 'rivals'?? This tactic brings to peoples attention the fact that Apple did it first. If Apple didn't take these steps then every damn company outside China would be rolling out cheap crap in Apple style casings!

I bet the Samsung's designers use a toilet every few hours too. When will Samsung learn to stop infringing on Apple's innovations?

Folding case is just about worthless as far as I am concerned. Like I am going to sit down for a long typing session using an on-screen keyboard.

Going on a limb here, but I'm guessing they are the cases depicted in that picture. I'm sure there is some legal method of tying Samsung to those cases.

And this is the problem with this article. That picture should not be included as that case was not made by Samsung or ever sold. The only reason to include that picture or any mention of those cases is to inflame the audience of this website. It is actually pretty shameful in my opinion.
