Wish our patent system was more like Germany; patent granted after working prototype shown doing what patent claims.
That’s not how it works in Germany. You can get patents there the same way as here.

apples own lead lawyer said (more than a decade ago) that they would not pay to license any patents unless they were sued, followed up by all the whining about how unfair it was that companies were suing them for infringing on patents...
Apple licenses patents without being sued.
 
$85 million dollars is small change to Apple, but patent trolls shouldn’t exist. They’re not actually doing anything productive to the economy except bullying companies to give out cash.

Not that easy, this suit has taken over 10 years, that’s a lot of up front litigation money from the accusing side, if wiLan is that small of a company no way they can keep up with the retainer fee

Please tell us your expertise on this matter...re the patent purportedly violated and the defenses. I assume you have both an engineering and law degree since you are weighing in.

If you think think you need credentials to hold a valid opinion then sports are going to blow your mind.

I don't understand the thinking of people who read a brief story like this and without knowing the legal and technical details simply assume that the company suing Apple is sleazy because Apple can do no wrong. Isn't Apple equally aggressive in defending their patents? Apple even patented the glass staircase that's in their stores. I'm sure if some other company did something close to that they would hear from Apple's lawyers.

Lol, even if that were Apple’s policy (it isn’t)... certainly of all people to realize information like that would be damning to Apple & should NOT be made public, it would be Apple’s “lead lawyer”, yeah?

It’s difficult to win attorneys’ fees in a patent lawsuit.

Yes, Apple will likely appeal. The judge may, on his own, reduce the damages as well, since he already hinted that he thinks the number should be far smaller.

I invent something, patent my invention, get paid for it, or I can sell it to a company (your patent troll), why shouldn't they make money out of it???!!!

Why should they? Patenting exists to ensure your work is protected but if you have no plans to actually use the patent and simply try and sue other companies that may or may not infringe it then that’s just immoral. I know businesses are generally morally bankrupt by nature anyway but you’d hope some may see sense in what they’re doing.

Ummm.... you can’t see how this stifles innovation & new products??
Imagine you are NOT Apple, with super deep pockets to pay these clowns- so, a small company that has ideas they want to struggle to bring to fruition & offer genuine products to people should be able to be blocked and decimated because some lame company bought up a bunch of patents that they’re sitting on with no intention of ever creating anything.... waiting for someone else to do all the work, then pounce and demand the profits of their work?
Ok. Sounds like the consumers lose, the scrappy company trying to offer us something new would lose- the only winner would be... you guessed it, the patent troll.
I’m glad that at least they’re getting caught up for years fighting to to get this money- which, to me, seems like blatant extortion.

Your analogy crashed miles from the landing strip...

More like- what if Apple had never had a construction project in their history, had no intention of EVER pursuing the building of a “floating” glass staircase, but purchased the patent from someone who thought of the exact manner how that would be done, then sat around for years, hoping that some builders somewhere would design such a thing, so they could swoop in & demand a paycheck.

It’s easy to make judgement calls in these instances because no technical expertise is required!
The only pertinent information is the fact that only one of the parties has no interest in, nor ability to bring anything to market- and literally only exists for the purpose of manipulating the legal system w/ regards to patents, & making money off of others’ work, having done none themselves, beyond hiring lawyers.
Those are the ones that are “in the wrong”.
Any further legal or technical details are posturing-; that’s the nuts & bolts, and plenty enough to form an opinion on the situation.
I think mine is clear.

It’s not square, it’s a rectangle. But hard to sell a phone that is a square with rounded corners. It’s a design patent, not a utility patent. Steve Jobs was talking about utility patents. And Samsung has a design patent for a rectangular phone shape with rounded corners as well.
