So exactly, obviously there's no bias based on donations involved here.
Yes (the amounts are similar) and no, there’s some evidence someone shared from the NY Post of a direct connection between Masimo’s CEO and Hunter Biden, and we just don’t know how involved President Biden is or was in Hunter’s business affairs. That sort of connection could certainly tip the scales in their favor, which is why avoiding the mere appearance of conflicts of interest is so important in business and politics. (For one, I have to report the stock holdings and board positions of my immediate family members due to financial regulations and the potential for conflicts of interest.)

Would be nice if 9to5 were to close this topic on the merits of political differences.

Masimo is a major player with medical devices: https://www.masimo.com/healthcare/

I've used some of their products for my research (but have no affiliation with the company -- they just had the products we needed).

They also happen to have a consumer audio division and own various brands including Bowers&Wilkins, Denon, Polk, Marantz, and more: https://www.masimo.com/consumer-audio/
I have heard good things about Bowers & Wilkins. The Px8 is suppose to be good but never had a chance to try it.

Can't Apple just buy out Masimo? Their total value is just $6 billion.

Could be an option but I doubt Masimo would be willing to let the company go for only $6 billion, especially not to a company with deep pockets like Apple. Even a hint that Apple is interested in buying Masimo would drive up the stock price.

One possibility: Apple settles with a US$2 billion settlement to Masimo. Apple has so much liquid assets on hand that US$2 billion is essentially "seat cushion money."

I am glad. Apple has acted like a monopoly in so many ways using its big company status to bully and steal IP. I think Apple should be split into multiple companies as the current Apple isn’t beneficial to anyone except Tim Cook and the wealthiest 1% who have benefited most from AAPL shares. Just like when Apple steals apps and integrates them into iOS and etc. The App Store is supposed to be there for developers but doesn’t stop Apple from stealing. That shouldn’t happen with a company this big.

Apple needs to pay however many billion dollars to settle this as it wrongly does it all the time. This isn’t a patent troll and nobody should claim that. Does patent law need to be overhauled, probably but so does it when massive companies like Apple essentially destroy competition and steal at will.
Is that you Karl?

Man that is crazy. I wonder if the prices of Ultra 2's will shoot up over the next few days. Gotta get one while you can!!!

Sounds like they will need to release a US version that is exactly like the normal version, but with Blood Oxygen measurement disabled in firmware. While a major bummer, not sure if it will slow down sales that much. And then work around the patent for the next gen.

[…]

I love Apple but hope it gets broken up at some point for the monopoly that it is -
It’s a legal monopoly and they are not AT&T of the 60s, 70s and 80s.
and at the same time love me some AAPL. The Apple way is now to steal innovations along the way without paying fair dues.
How do you know they steal inventions?
Whether it be from Qualcomm-sized companies to app developers who make the ecosystem work and should be protected from Apple’s theft of their IP but aren’t. Apple acts like a grade school bully - and the principal just got wind of what it’s been doing, again. Love it.
As yogi Berra famously said: “it’s not over til it’s over”.

So dumb. Should not be made to stop selling them. Everyone is always after the successful companies. If Masimo was a successful company, they would be a household name and would be selling out of their products. Hmm..

Guess the value of the newest AW’s will go up in the used market if this stop sales lasts a long time though.
Maybe do just even the tiniest research on Masimo....

poaching employees should be ok, but if Apple is using Masimo's technology then they should just pay for that.

Apple today said it will be pausing sales of the Apple Watch Series 9 and Apple Watch Ultra 2 in the U.S. later this week due to an ongoing patent dispute with medical tech company Masimo related to blood oxygen sensing.

In a statement shared with 9to5Mac, Apple said the Series 9 and Ultra 2 will no longer be available to purchase on Apple's online store in the U.S. starting December 21 (after 12 p.m. Pacific Time), or from Apple retail stores in the U.S. after December 24. The devices will remain available to purchase in other countries.

In October, the ITC ordered a ban on some Apple Watch imports into the U.S. after finding that Apple violated Masimo's patents related to non-invasive blood oxygen sensing, also known as pulse oximetry. U.S. President Joe Biden has until December 25 to review the order, but presidential vetos of ITC import bans have historically been rare. In the meantime, Apple said it is preemptively taking steps to comply should the ruling stand.

Apple added that it "strongly disagrees" with the ITC's order and is "pursuing a range of legal and technical options" to ensure that availability of the Series 9 and Ultra 2 resumes in the U.S. as soon as possible. Apple told 9to5Mac that it plans to appeal the ITC's order with the U.S. Court of Appeals for the Federal Circuit on December 26 if necessary.

Apple's full statement:Since 2020, Masimo has accused Apple of poaching its employees and stealing trade secrets in order to develop the blood oxygen sensing feature available on the Apple Watch Series 6 and newer. In January, an ITC judge ruled that Apple had infringed on a Masimo patent relating to light-based technology for reading blood-oxygen levels.

In a previous statement, Masimo CEO Joe Kiani said the ITC's decision "sends a powerful message that even the world's largest company is not above the law."

Hold on there a minute pardner…two posts up MR has news Best Buy and Amazon have low low prices on Apple Watch Series 9. Now they all can’t be right, right?

I'm now waiting for the comments "Apple should pull out of the US", from the same people that claim they should pull out of the EU whenever there's EU regulation to follow.

Edit: The amount of people taking this comment serious is both hilarious and sad.
Government regulation is not same as patent dispute.
Politicians/government doesn't know nothing about technology they shouldn't be dictating what technology companies should be using in their products.

Why can't they just license the patent at this point? If they lost, just pay up? Apple can afford it and surely the cost would be less than the money from lost sales?
It’s not that simple because it will invite patent trolls to the party. Apple should fight this to the bitter end to show patent trolls that attempting to collect royalties will cost them a small fortune in legal fees with no guarantee of a payout.

If Apple knowingly stole this idea, that’s another issue entirely and Apple should pay up or find a workaround.

One thing is for certain; the patent system is badly broken and no politician is willing to fix it because there’s no political capital to be gained.

Why not? Sales are not paused yet- stores can sell for however much they'd like to. Unless you're just being sarcastic about the sale timing.
