They guy has a valid point. There should be a way to delete the iOS 7 setup file and regain the storage. No way is Apple going to do this unless pushed.

Assuming he is able to serve Tim Cook with the complaint.
 
What prevents this dude from just restoring the phone from backup? The backup doesn't contain this pre-download.

Considering the consumer rights attorney they hire, this may get into the courtroom.

However, if you look at the license agreement, Apple has the right to push data to your phone for whatever reason.

Also, those who resist upgrades in software have a very poor history of fighting this tide. They either move to an alternative platform or cave in.
 
I'd love to see how many law suites this guy has issued. It's a primary source of income for thousands of people, and Apple has the deepest pockets. All this joker needs to do is install the upgrade to solve the problem. Not wanting the latest and greatest is his problem, not Apple's. I purchase Apple products because of their record on providing me with the latest and greatest. If this character doesn't want that, he shouldn't be purchasing from Apple in the first place.

Really? How many $50 lawsuits is he going to have to file to live on? Did you even read the article? I completely agree with his problem. Us jokers shouldn't have to choose between upgrading or permanently losing 3GB of very precious storage on our iDevice.

Thats not a solution for people who dont want iOS7. There is nothing wrong with keeping old firmware, the point that because you decide to keep it, it will take up 3GB of space to not be used is outrageous. As someone stated earlier, that a big chunk for a 16GB iPhone. He is suing to bring attention to the issue, seems like a less reasonable way to do it, but everyone has their preferred methods to be heard. Whether this is even a case or not is up to the court.
 
This dope sued Tim personally. This is going to get booted out of court so fast... My bet is that someone is desperate for attention.

Apparently you don't understand how small claims works. Tim, or his designated representative, has to show up, or it's an automatic judgement. Tim or someone who he's paying has to show up to argue, about $50. Or just pay the $50. Or be cited for contempt.

I'm glad it's gone. Rather than constructing an intelligent post to explain why you disagree with something, people would just press the down vote button. It was the perfect tool for trolls/fanboys.

Well... Any representative Apple might send will probably command more than $50/hour in wages, so probably is cheaper for Apple to just ignore the suit and pay $50...

And the reason isn't frivolous, I agree he should just update but it is his phone so he can do with it what he wants. If he can only get his right to undo an unwanted modification of his property by suing then so be it.
 
This is a significant problem for users of iPhone 4 that do not want to upgrade at least until the terrible performance problems have been resolved. There needs to be a delete button added to the update screen to remove auto downloaded files, that's all that is required, simple, no fuss, no lawyers fees just a simple logical solution.;)

Bored of being broke. But not bored of being opportunistic lazy schemers.

Someone needs to make an iSue app for suing Apple. Type your complaint, then tap sue, then wait for the settlement check.
 
I usually mock when it comes to these stories, but this is a valid gripe IMO. If someone chooses not to update to iOS 7, they lose the amount of space equal to a couple hundred songs. The fact that your phone automatically downloads it and there's no way to delete it is insane.
 
Apple charges $100 extra for 16GB of storage. He has a right to sue for $50 for an unnecessary amount of data being used on his phone. The fact that it downloaded itself on there is also a problem.

Unlike most people, I believe he is suing for a proper amount and not the extraordinary $1million like typical users.

I like your logic. If I sue you for $5 million for having hair, it's frivolous, but if I only sue you for $50 for the same reason, it's somehow *not* frivolous because it's such a small amount. (I *almost* hope someone uses your reasoning against you in a court case at some point.)
