Solution

As posted already it is possible to erase the 3gb somehow. After this - before it redownloads the upgrade - you can fill up your ios device just enough so there is no longer space for the upgrade.
 
I think everyone is missing something in this thread:

Legally, Apple has done nothing wrong. There are no laws on using up someones disk space or automatic downloads, or else there would be a lot less websites with popups and files that auto-download when you open a website, would probably also need to remove videos and images because technically they are downloaded without my consent. In Fact any website I visit that does not have the information I am looking for is technically wasting space on my computer/iPhone. Everytime I play an Online Game on my iPhone it downloads all my save data from the server and wastes space, It should be left on the server and read from there. In Fact all my apps should just be run from iCloud.

This really comes down to a suit over Customer Service, and the courts are not the appropriate place to discuss these issues. Apple is not required by law to have any customer service. If you are dissatisfied with a product take your business elsewhere.

If you do not like that your iPhone automatically downloads an update, do not buy an iPhone.

Legally, Apple could put in the iOS terms of use that you have to update your iPhone in order to continue use. In fact plenty of companies do this. Microsoft forced IE8 on all WinXP machines a few years back. I had automatic updates turned completely off, and came home one day to an updated IE.

In Fact, Apple could remotely disable or brick your iPhone at any time just because they want to and you cant do anything about it. There are plenty of devices that require a server connection or other system in place to work, and if the company shuts the service down the devices stop working. Can I sue the FCC cause my old TV no longer works since it only receives SD broadcasts? My old Cable Modem no longer works because Comcast now requires DOCSYS 3.0... Old Cell Phones no longer work because the cell technology is no longer used... list goes on and on and on....

Whats next sue over automatic security updates? and then sue because a security hole was exploited due to not forcing an update?

and really he wants money for this? get over it you are not out anything just because you have 3GB used space on your phone. Well ok maybe you are unable to SPEND MORE MONEY to download apps, so he wants compensation for saving money?
 
People sue for just about anything when they're bored, don't they? :D

In fairness to the guy, he's asking for $50 because he has to ask for a figure, he's doing it to force Apple into taking action - not trying to get rich.
 
This guy must have a 16GB iOS device. If Apple added a separate chunk of storage to use for the operating system and temporary files, then it wouldn't matter, but then again if they dropped their lowest tier devices and started with 32GB as a minimum then losing a gig wouldn't be so bad. I'm really hoping they drop the 16GB tier. And that whole thought is without commenting on whether this guy is a bit bonkers.

Imagine having an iPhone 4 8GB model and then seeing 3GB's of space used up by an update you're not even going to install.

For those of you who are telling us to update to iOS 7. Who made you a divine being to tell us what to do?

I bought the device and I can use it however I feel like doing so without actually breaking any law.
 
This is one of those rare lawsuits where the guy isn't trying to get rich off of something trivial, but actually get a company to make a change. I bet he's not the only one out there who would benefit from this. As others have stated, this could significantly impact your experience.

At least when Windows 8 tablets come with 32 gb of memory but only have 200 mb usable space when you buy it, it's in the fine print :D
Yes, it's more for the the principle of the situation. But still... I'm sure he spent more than 50 bucks putting all this together. :eek:
 
So for those offended by the lawsuit, what other course of action would you recommend that would have a chance at getting the results he's looking for? I'd love to have seen the guy take an alternative approach but I can't think of what that would be.

1) Update or 2) Sell it and buy a larger capacity iPhone (there's dozens of devices for sale on iOS 6) or 3) Sell it and try a different platform (probably WP8).

I'm not even slightly offended, if anything I'm a touch amused - I guess my time is worth +way+ more than the effort required to resolve this to to [his] satisfaction. See following quote :D

what a bunch of whiney ***********. Why don't they just install iOS7 like most of the world? You're going to have to do it eventually, legacy support never lasts long. Everything that works in iOS6 works in iOS7 except for jailbreak. The only difference is that iOS7 has a ton of more and useful features which is hard not to like, but aesthetics. If you don't want to upgrade based on aesthetics, that's just vain and silly.

That's like saying we should upgrade all our working Windows PCs to Vista or greater, just because XP is not going to be supported much longer... without worrying about aesthetics or speed or free disk space.

Seriously, just got an iPad 2 for my wife's kindergarten class, and from what I'm reading, I should hold off on installing iOS7 until it's more optimized for tablets.
 
To be perfectly honest, it's surprising how dated iOS 6 looks now having used iOS 7 for the last little while.
 
I think he's in the right. There should always have been an option in settings that prevents this from happening in the first place.

Is suing a bit silly? Maybe. But arguably no sillier than Apple shoving their OS update onto your phone without you desiring it, and/or without giving you a sensible way to remove it after the fact.

Agreed, and $50 is not some obscene claim. He's clearly not just making trouble to get rich, despite what some folks on MR might suggest
 
Or just update to iOS 7 and get over it...

Simple solution: Install the iOS 7 download and get over yourself. iOS 7 is great, live in the now and not in the past.

Obviously the newbies don't get it. iPhone OS 7 is not all that great with older devices. Also, some people don't like the changes so they'd rather stay on the old OS.

People want choices, and this is one of them. Cook & Co, should respect that.

I wish I didnt update to iOS 7 on my iPad......i knew it was buggy as i saw how behind it was on the Beta 6...but it auto-downloaded so i was like what the hell...and did it.

Well for one Android devices dont get forced to download any updates at all. Maybe get a notification but thats it.
 
Realistically, if the user doesn't go through with the install of the auto-download after, say a week, the download should auto-remove itself. Only seems logical and reasonable IMO.
 
Wow, some of these comments saying he should shut up and upgrade to iOS 7 are so sheepish, and this is coming from someone that likes iOS 7.

Would you be saying the same thing if Microsoft constantly nagged XP users to upgrade to Vista with popup bubbles and automatic downloads?

There's a whole host of reasons why people might not want to upgrade to iOS 7. Just because it suits your preferences doesn't mean it should be forced down everyone else's throat. People are entitled to not have the device they bought dramatically altered.

Whether it's a more modern OS is not even relevant. Again this is coming from someone that likes and installed iOS 7.

What a sad little community this place is sometimes.
 
Reading people defending Apple in this case and chastising a user for not wanting to upgrade is hilarious.

A person bought a product. An update gets released that the user doesn't want on his/her device and they now have 3GB less storage than what was originally advertised. Ridiculous.
