Ridiculous. Get a ****ing refund and watch it another way. This dude needs a hobby.

This started years back. They found out it was easier to film, then put half a season out then go back to filming and get the other half of the season out. Easier on the crew, actors, etc. and also good for competition on air.

Battlstar Galactica did this in Season 2. 20 episodes, split into two 10 episodes seasons then started doing this from there on out (Syfy standard to split into 2 parts per season).

What they'll start doing is just not calling it say season 4 and 4.1 but 4 and 5 to avoid this stuff.

Okay, Noam Lazebnik, you've had your 15 seconds of dubious fame.

Most of us would contact Customer Service (and anytime that I have needed an adjustment in iTune charges, Apple has been most co-operative) -- but (reportedly) you launched a lawsuit in California claiming you are owed between $14-$22.

You may claim you are acting on behalf of others, but as a Breaking Bad subscriber (who does not expect 16 episodes spread over a two year period to be given to me as one season) you do not represent me.

If you want the extra shows free, try torrents.

I'm not reading through everyone's comments to see if this has been mentioned yet; however, iTunes has employed the same B.S. tactic with the children's show "Adventure Time". This is evident by comparing the episode guide to the season offerings provided in iTunes.

This season 5/final season splitting is akin to last year's iphone 5/iphone 6 naming war. This can't end well.

Should I sue bestbuy is I walk into it pay $21.99 for it then realize it only 8 episodes?!

It depends- the DVD/Bluray box shows playtime of the collection and most probably a list of the episodes. As that info is available to a "reasonable person", the "reasonable person" knows what they're buying. Conversely, from what I gather iTunes was including all episodes (past and future) of season 5 in the season pass, so a "reasonable person" would infer that all 16 episodes of season 5 were included in the pass. The situation is entirely different with your scenarios with bestbuy, so I don't see how the two even begin to compare...

Apple (when it comes to video/audio) is a distributer, they don't make the content, they just give you a convenient location to buy it.

Again Apple doesn't set pricing for video (they have a hell of a lot of pull with music), they just distribute what companies ask them to for a fee.

Like I said, the contract is with Apple, and just because Apple puts (C) on the series, doesn't necessarily mean that whoever owns the copyright is the "seller" for whom Apple acts as an agent. If Apple were acting as an agent for someone without expressly identifying on whose behalf they were acting (let's be frank, we don't know what rights AMC actually has to the show) they are liable under the undisclosed principal doctrine. Like I said, law and stuff, you know...

So if he wins and you have a season pass to BB season 5 and "the final season", and Apple have to issue you a refund for "the final season", you will gladly return that refund to Apple for their corporate coffers? Give me a break!

Sadly you are one of the few who use the brain. IMHO the problem here is AMC, anyway it is stupid to sue the distributor (Apple). Apple could refund anyone just to be nice, but users will complains anyway.

I seriously wonder why/if Apple has no clause in the store (next to the buying button) to exclude any claims due to changes of an (partly) unreleased article after buying.

I think I've seen such clauses next to pre-order items. Something like "contents of this order can change until the final release of the item."

You are correct sir!

Amazon charges per-episode while the season is ongoing (one can 'subscribe' and get a 15% discount)

Only after the season is over can you buy the full season for a fixed price.

Correct me if I'm wrong, but to my knowledge Amazon and Microsoft don't charge for a full season pass before all the episodes are available, or do they?.

Amen. People are just Apple nut huggers abs believe the company does no wrong. Ever. It's completely ludicrous.

Even if it isn't Apple's fault entirely they should have made it clear what you receive with the season pass and they didn't.

And companies wonder why they lose to pirating...

Couldn't agree more.

They can't.

If they call it another Season they are liable to pay for contracts etc.

Think of it like this - when most actors sign up for a TV Pilot they are required to sign a 6 Season deal. That means they really can't negotiate for more money until the show exceeds 6 Seasons (it's happened before with big shows like Big Bang and Modern Family, but smaller shows like The Middle it isn't going to happen). If they start pushing Seasons it gets closer and closer to contract time regardless of how long it's been. So split them and call them one.

It rarely happens with one year breaks (if it does, it could be because the show wasn't doing that well and needed some time to fix mistakes and/or the network didn't have room for it on the schedule). It mostly just a cable thing to show episodes in the Summer and Winter.

Was not clear

This was made clear though, last year.

When I bought Season 5 it said something like "will include all episodes as they become available". I notice that iTunes often does not spell out how many episodes the season will contain - as was in this case for "breaking Bad S5". And no, it did no say Season 5-part1, nor 5A. It just said "Season 5".

I realize that this is AMC's fault too - but Apple should really insist - and show something like "this show is scheduled to have 8 episodes". But if it contains 9; or god forbid only 7 then people will have another reason to go to court ... so I guess it's a catch-22.

Once you start with iTunes, "it pulls you iiiiiiiiin ..."

An Ohio man, Noam Lazebnik, has filed a class action lawsuit against Apple for failing to provide iTunes users who purchased a "Season Pass" for Breaking Bad with the full season of 16 episodes, reports GigaOM

Did iTunes actually promise 16 eps.

Because if it didn't his argument could get weakened. If there is a TOC about content providers having the right to change content etc, his case might end there.

Yes an it's a sucky high price etc but is it Apple's fault, perhaps not

This is a common technique to shorten the distance between show broadcast and DVD sales. They split the season in half and sell you half a season at almost full season price. Then they sell the second half to you at the same price. It sucks and is just another technique to get faster profit for executives and shareholders. It serves no other purpose, except maybe to provide argument for not canceling a show ("look, we're making good money here").

Where Apple is at fault is in not recognizing this technique when they sell their season passes. It's could almost just be a dumb data entry kind of mistake. The bigger problem is that there's possibly no way for Apple to sell a season pass to such a broken season because they're selling based on DVD releases, not season content.

I went to the movies, bought a ticket for "Lord of the Rings", watched it. And half a year later, I had to pay again for the second part! And what's even worse, I had to pay for the third part as well!

There _is_ a table of contents showing 8 episodes.

2. I purchased the Breaking Bad "Deluxe Editions" which so far include almost 200 bonus features, ranging from commentaries, behind the scenes, interviews, and all the little easter eggs like Saul commercials, music videos found in episodes, etc. Do you know of anywhere else I can get these bonuses legally?

Now there is an area that peeves me. Folks that bought the eps as they were airing can't get this bonus stuff without buying the seasons again.

I applaud the parity with what typically is only in disk sets but either make it a separate package or give us credit for having bought the eps and 'complete the season' like how many of the music deluxe albums do it when you just bought a song or two (you can use the song against either the regular or deluxe)

Was there when he bought it. If he got it at the top of the season probably not. But the question stands, did it say anywhere how many eps he was getting when he hit buy

Just wondering how long it takes for an episode to be available on the iTunes store? I really want to watch the latest one in HD but it's not there yet, even though it was shown yesterday in the US.

I could watch it on a dodgy site somewhere but the quality always sucks. Hurry up iTunes!

It's there. I just downloaded "To'hajiilee".
