It seems like Epic is playing a schoolyard game, but that game was over when the case went to court. And it was REALLY over after the decision. So now that it looks like it is REALLY REALLY REALLY over ... oops, what was that over there, was that a Martini Bird?
 
If Apple keeps going down that road then the monopoly argument will start looking mighty convincing in short order.

As the judge stated “it’s not illegal to be a monopoly”. It‘s not illegal to be a monopoly of your own products - it’s expected. Apple was judged NOT TO BE A MONOPOLY in the Mobile Games Market, which the courts decided WAS THE RELEVANT MARKET. You cannot make the market so small as to only encompass your own product (the iOS APP Store).

Yes and no. Customer goes directly to website, Apple gets nothing. Customer clicks on a link within the app that goes to a website. Apple is entitled to commission. (it's not clear how apple collects, but they are entitled according to the ruling)
 
Watched the Nineteen-eighty Fornite video again. That was such a dumb move by Sweeney which deliberately was designed to damage Apple's brand.

It states that Apple banned fortnite in "retaliation" when it was banned for breach of contract. Apple might have reason for a defamation suit.

Maybe. But every day Fortnite is not back in the App Store is another day of lost revenue for Epic and at this rate, I wouldn’t be surprised if Epic ends up shooting themselves in the foot and gives Apple enough leverage to justify themselves doing something drastic like blocking the entire unreal engine or something.

The reality is that Epic has done the entire developer community a massive disservice by going through with this reckless gamble of theirs. Prior to this, Apple was still open to making concessions precisely to avoid lawsuits like this. Now, what incentive is there when the lawsuit thru were hoping to avoid has taken place, and ended in Apple’s favour?

Meaning that Apple by right is under no obligation to do anything more for its developer community and any further change will have to come via lawsuits.

Epic is nobody’s hero. They did all this for their own selfish gain and risk dragging the entire developer community down with them.

Uh, because it’s a huge distinction, obviously. A smartphone is pretty much a necessity in any developed country while a gaming console is not. Last time I checked, nobody’s banking or applying for jobs on a PS5.
No a smartphone is not a necessity. A cell phone is. My grandparents are still using flip phone Jitterbugs and they get by just fine. Therefore, not a necessity.

Not exactly. Developers can now link to alternate payment sources, but they cannot add it directly in the app - which is what Epic did.
 
Nintendo does not sell anything hardware at a loss, with the exception of the 3DS after a much needed price cut.

Sony and MS make up a ton of money from "licensing" when games release on their console.

Who cares who sells what at a loss or not, that's not anyone's problem but the companies deciding that.
I honestly do not believe the whole "selling at a loss" argument. People need to keep in mind that bulk orders are usually cheaper, it costs Sony far less getting components that you or I could. Also, if they are truly selling at a loss, then they are having a very rough time with COVID and supply chains and lack of customers actually getting the console and scammers just holding on to them.

I also agree with you, the law should not be that flexible. If Apple were to sell the iPhone for 1 cent at a loss, all this would just go away?
 
No they won’t. Epic were in breach of their contract with Apple. There is no one that can make Apple allow Epic back if Apple doesn’t want them back.
People don't seem to understand that the judge also explicitly stated that Epic did breach the contract so it really is up to Apple to allow them back in or not. If you breach a contract, you typically won't be allowed back in.

Also that iOS isn't a market at all because it isn't licensed or sold. You can't have a market without buyers and sellers. It's part of the device, where it competes with other devices. As stated in the Order:

plaintiff’s identification of a “foremarket” for Apple’s own operating system is “artificial.” The proposed foremarket is entirely litigation driven, misconceived, and bears little relationship to the reality of the marketplace. Quite simply, it is illogical to argue that there is a market for something that is not licensed or sold to anyone. Competition exists for smartphones which are more than just the operating system. Features such as battery life, durability, ease of use, cameras, and performance factor into the market. Consumers should be able to choose between the type of ecosystems and antitrust law should not artificially eliminate them. In essence, Epic Games ignores these marketplace realities because, as it presumably knows, Apple does not have market power in the smartphone market. Rather Apple only has 15 percent of global market share in 2020.

The Court didn't mince words on this point.
 
What do Epic expect, the broke the contract and Apple rightly banned them from the AppStore just like any other small developer would have.

If they had an issue they should of took it to the courts and in the meantime continue to keep to the rules they agreed with on the AppStore instead of trying their luck and then hoping their clout was enough to force Apple to back down

Apple was fair it gives them the chance to remove that feature and reinstate the App while they could challenge their dispute in court now they find themselves band and due to ongoing legal battles they just going to have to wait even if that’s 5 years.

Epic learned a valuable lesson that is don’t think you can brake the rules because you are somehow privileged you take any disputes like this to court and let the law decide and if they did they could of now added that feature 🤣
 
I’m pretty sure that Fortnite being banned from iOS isn’t going to bankrupt Epic anytime soon. Stop drinking the koolaid.
And yet you are the one crying over how Apple is being mean. Apple is not the one that deliberately and with full intention broke their contract. Apple is not the one that started this fight so why should they turn around and welcome him back while Epic is busy putting out press notices of how they are going to appeal the decision and that they wont come back till they have it their way, suggesting it was their decision. Apple is just exercising the right the judge gave them in the trial, which is to remove Epic Games. Through out this whole thing Epic has been acting in bad faith trying to get all the benefits of Apple's network, reputation and client base without paying. Epic is doing this all for Sweeney's ego (He got all butthurt when he sent an email to Cooke telling Apple how to run their business and Apple was like "we got this just fine over here") and pocketbook. Personally I feel if Apple was actually being vindictive or abusive they would removing Signing for the Unreal Engine which would mean a ton of revenue loss from Epic and a lot of other developers moving to different game engines. Sweeney's actions are what is causing this, Apple shouldn't have to just take abuse from Epic and just let them back in, and honestly Epic now has a reputation of being untrustworthy, which is what happens when you break contracts purposely.

Epic used a back door to implement their own payment method, breaking App Store rules (and bypassing Apple’s commission - whatever ones opinion on the commission amount, clearly, they were breaking the rules they agreed to). You are correct on why they were booted. The judge did not tell Apple they had to allow that, though (in fact, court agreed that Apple were legally ok to dump the dev account for that) - they said that Apple had to allow a link or button noting other purchase options in apps. You make it sound like they would be required to allow a third-party direct payment method, which is not what happened at all.

The interpretation of that ruling has been highly debated. There is a strong argument that Epic's alternate payment method would still not be allowable.

Either way Epic hasn't been allowed back on the App Store so they can't even take advantage of it whatever will be allowed now.

So yes, Epic Lost.

Epic lost, yes, and you’re on the right track, with a bit of incorrect details. Epic’s alternate payment method could be allowed - if Apple wanted it to be - that would be true regardless of if this case was ever brought. Apple simply does not allow it, and does need to allow it. The ruling essentially said Apple has to allow a link or button to another place they could purchase it - I haven’t heard anyone think the ruling might require a direct payment option. I doubt that barring a different court ruling at some point in the future, Apple would ever allow a direct purchase option via a 3rd party payment.

The judge did not say that. The judge only indicated Apple can not block in app notifications pointing to another way to pay (website, pre-paid cards etc.). Epic got kicked out for creating an in app payment bypass that was not just go buy it on the website which Apple has always allowed just not a big in app notification which now they need to. So when you go to buy something in an App going forward as a developer you can put up a notice saying that the same item can be bought via website or pre-paid card and possibly for less). Epic basically is whining because now Apple has decided their bad faith behavior means it is not worth it it Apple to let them back. Had Epic just taken the verdict, not gone out and publicly continue to bash Apple and shout that the trial decision was unfair, Apple may have just let them come back with the existing rules in place. Personally I dont think Apple is wrong to just say screw it with Sweeney and his publicity stunts where he tries to get as much press time to complain how he really won and the judge took that away from him.
