If Epic had not appealed the decision I can see where Apple’s stance is a little harsh but so long as Epic chooses to fight this battle, I don’t see where Apple would take the risk of further litigation.
 
See also in about 2 years from now… “oh god, remember when Apple kept pushing it’s ancient decaying lightning port for the sake of royalties before it finally collapsed under large data loads and they accepted a full transition to USB?”

By the time Apple exhausts its appeals, Fornite will hopefully be a game thats run its course and just go away.
 
That’s how, one is a general purpose computing device, the other isn’t. It’s like comparing a laptop and a smart fridge.
Which still gets us nowhere close to answering my question of why that's in any way relevant.

Leaving aside the fact that it's wrong. Xbox runs Windows, PS4 runs a BSD variant (as does iPhone). Your fridge probably runs some flavor of Linux too, actually.

ProRes is a fully established format. The only reason its launch is delayed on the new iPhones is to keep the file transfers out of YouTubers reviews. Apple sensibly identified the risk of a YouTuber showing a real-time transfer of a ProRes file over lightning as the most embarrassing aspect of all their current products.
 


Apple has no plans to allow Fortnite to return to the App Store in the near future, Apple's lawyers told Epic's lawyers this week. Further, Apple does not plan to consider requests for the reinstatement of the Epic Games developer account until the court's judgment is "final and nonappealable," a process that could span years.

Apple provided this information to Epic Games after Epic CEO Tim Sweeney emailed Apple's Phil Schiller and asked for the Epic Games developer account to be reinstated. Sweeney said that Epic would adhere to Apple's guidelines "whenever and wherever" products were released on Apple's platforms, but he went on to explain that Epic would only reinstate Fortnite if Apple adheres to the "plain language of the court order" and allows apps to "include buttons and external links."


As was outlined earlier this month, the judge overseeing the case ruled that Apple must allow developers to provide links to external payment methods alongside in-app purchases if developers want to do so. Apple has until December to implement the court's terms, and the company has not yet decided if it will appeal the decision, nor has it provided details on how the court's "metadata buttons, external links, or other calls to action" to direct purchase mechanisms will be interpreted and enacted.


Though Apple was ordered to change its "anti-steering" rules to allow apps to direct customers to other payment methods, the ruling was largely in Apple's favor and found that Apple is not a monopolist under federal or state antitrust laws. Epic, unhappy with this decision and appealed the ruling, prolonging the legal fight between the two companies. Apple too might appeal the judge's decision, but again, has not yet opted to do so.

Apple said that due to Tim Sweeney's public statements on the outcome of the lawsuit and Epic's "duplicitous conduct in the past," it has "exercised its discretion not to reinstate Epic's developer program account at this time." Apple is well within its rights to deny the reinstatement of the Epic Games developer account because the court decided that Epic breached its contract with Apple and Apple's termination of the account was "valid, lawful, and enforceable." Apple has no legal obligation to restore the Epic Games developer account.

Sweeney shared the letters between the two companies on Twitter and said that "Apple lied" when it previously said that it would welcome Epic's return to the App Store if it complied with the App Store rules, but Epic has demonstrated an unwillingness to comply with the App Store terms and Apple may be worried that Epic would just attempt to find another way to skirt the guidelines if the account is reinstated. Apple wants to wait out the appeals process before making a further decision on the matter.

Epic Games was also ordered to pay Apple $6 million, which is a 30 percent cut of the revenue that it collected from the Fortnite app using its illicit direct payment option. Epic paid the fee earlier this month.

Does this only affect Epic Games in North America or did Apple go after the Epic S a R L or whatever it's called in Switzerland, the one that owns the engine?
 
This all will end like SCO, a long battle, but Apple will lose the whole fight around the world.
Antitrust and the digital market place laws will be rewritten, specially in the EU.
It’s just getting warm and starting, but not over yet.

Makes sense seeing how gaming consoles are specialized appliances often sold at a loss or very minimal profit and rely on software licensing to generate revenue. I’m pretty sure that Apple has never sold any of their devices at a loss.
Nintendo does not sell anything hardware at a loss, with the exception of the 3DS after a much needed price cut.

Sony and MS make up a ton of money from "licensing" when games release on their console.

Who cares who sells what at a loss or not, that's not anyone's problem but the companies deciding that.
 
Apple are such a bunch of petty sore losers, it’s really kind of pathetic. Everyone knows that they’ll be forced to reinstate Epic’s account eventually.
This was Apple's only real option, they need to set an example so that everyone doesn't just try and break the rules, and "maybe we'll get away with it, maybe not, but if we loose, then no harm done, we'll be back in the Apple Store soon." If you want to go after Apple, you'll have to go after them the correct way, through the court, not by breaking contract, stealing money, and a smear campaign.

Couldn’t a reviewer post a video a few months later when ProRes is out?
 
Except in the case of Epic. They specifically told EVERYONE that they INTENTIONALLY didnt fill the tank in PROTEST to the rules.

So yeah. No forgiveness is owed.

more like: You let me borrow your car for a month on the condition I pay that month lease amount and I paid cash and you got all angry I didn't pay with Visa or American Express."

Man you know what? I’ve heard great things about the Fortnite game but I’ll be damned if I’ll ever play it now. Even if Apple decides to reinstate Epic they’ve soured me so much I refuse to have anything to do with them. They can rot for all I care.
 
It was made clear that Epic had planned this years in advance now he is crying about the consequences.

They can use alternate payment portals but are still liable for Apples fees.
