You can't call someone a loser until you learn how to spell the word loser.

It doesn't matter what dishonest geniuses tell you. Read the fine print in AC+.

"ADH (accidental damage from handling) coverage does not include (a) protection against normal wear and tear, theft, misplacement, reckless, abusive, willful or intentional conduct associated with handling and use of the Covered iPhone,"

Also, "(v) The Plan does not apply to cosmetic damage to the Covered iPhone, including but not limited to scratches and dents, that do not otherwise affect the functionality of the Covered iPhone."

It's really no different from dishonest insurance adjusters telling you to deliberately damage your car then file the claim.

I represented a guy who was homeless. During the winter he went into a restaurant, order a nice meal and then told the owner "I am stealing this meal", and waited outside the restaurant for the police to come. They took him to jail, probably saving his life from the winter cold, where he spent 120 days in jail. They still wanted to give him probation. What is your opinion on that?

Everything is all about the context of the situation and you cannot be a moron who just accepts and quotes a AC+ policy.

Without knowing the full details of the case, my opinion is if the guy was mentally ill (given the disproportionate number of mentally ill people among the homeless), you didn't do a good enough job as a lawyer. If the guy wasn't in fact mentally ill, he got what he deserved. Make the punishment too lenient and he's liable to do it again. Steal a meal and spend only one day in jail (along with more free meals) doesn't sound too bad.
 
According to the AppleCare+ terms and conditions it basically covers hardware/battery defects and accidental damage from handling that results in operational or mechanical failure.

It specifically says it does not cover cosmetic damage (scratches and dents) that don't affect the phone's functionality; defects caused by normal wear and tear; or preventative maintenance.

If you are able to walk into an Apple store and have them replace your phone under AppleCare+ without any defect/damage, immediately go buy a lottery ticket because it's your lucky day.

These warranties are written by lawyers who need other lawyers to decipher. It's like auto insurance, you can't get a straight answer, there's always some f'ng clause written that prohibits you from this and that.

All you have to do is just throw it into a puddle of water and say you when canoeing and it fell out when you fell in the water.

it was appointed to me and he was given credit for time served. I guess we will just have to agree to disagree on the AC+ thing. Our moral compasses are different and I would not feel bad at all "dropping" my iphone for a new one under ac+

But you see what I mean. I would think somewhere around 7/10 people would "drop" it.

So 7/10 people have no problem committing a fraud doesn't make it any less of a fraud. AC+ specifically prohibits that and it doesn't matter what anyone else (including a genius) says.

Count me in on the side of don't intentionally break it just to get it replaced. But that's just my opinion. YMMV.
 
Prior to buying AC+ I specifically asked "if I am willing to pay the $49 and use up one of my incidents, does it include coverage for scratches or dents from dropping that a Genius determines are purely cosmetic".

Without any hesitation I was told "yes, scratches are physical damage and that's covered".

Seeing the cut and paste from the terms and conditions it's rather clear that's not the case.... But I'm sure many people were told the same thing as me and that's why they think its covered.

You registered in June of this year, have over 1900 posts. That means you have posted about 489 per month or 17.44 posts per day, and you pointed out that you are an attorney ? You spend an awful lot of time on these forums to spend as an attorney effectively. Me thinks you are not telling the truth :confused: :p

It depends on the lawyer and the type of employment. A part time lawyer might work as few as 3, while a busy lawyer may work 15 hour days.
The average is about 8-10.

You spend an awful lot of time on these forums to spend as an attorney effectively. Me thinks you are not telling the truth :confused: :p

I work very fast and very efficient :)....plus I am in front of a computer every day. I work long days (start at 6:00am), but I think forums keep me sane.

And that is fine, if in normal use your phone gets scratched up and you take it in and they decide to replace it after looking at the phone. I don't think anybody has a problem with that. The problem I have is people who suggest you willfully damage your phone by dropping it to "make it a sure thing" and then lie about the nature of the damage.
