They do not make you wait out your contract before upgrading. They have the exact same policy as ATT. Upgrade at 20 months, date can not be adjusted. Trust me, I spent the whole day working on this trying to get a upgrade 16 days early.

are you saying that verizon will put in $250 if you are a year into your contract like ATT?

No. At Verizon you may upgrade at 20 months. Unlike ATT there is no early upgrade. But 20 months is not at the end of contract. That was my point.

That is correct. So now I have to wait until early October and take my chances that there will still be phones available at that time. Of course there will not be.
 
I have followed this thread closely because I like many here took my upgrade on the 4s and my official eligibility date is 5/8/13. I am happy to say I ordered a 32gb black iphone 5 for $322 with taxes and shipping. It took several calls but I received a huge brake last night with a AT&T representative when she reviewed my account and stated " I have been valued customer since 2005, prompt payments, and very limited credits ever applied to my account" she tagged my account as eligible and said I would be able to upgrade in the morning just have the representative look at my account notes. I got the standard brush off twice this morning when trying to order but I finally got someone to put the effort in and bypass my date. She was very resistant and expressed that they had a meeting this morning and were told NO EXCEPTIONS! However if you’re in good standing and a valued customer it certainly is possible for them to move up your eligibility from 5/13 but it takes little effort and luck. Since it took most of the day to get this pushed thru I obviously will be on the 2-4 week shipping list and for that reason I was even refunded my $36 activation fee.

I can hear it already...proof or it didn't happen...

My online order status won't update for 24 hours but my Discover card shows the processing charge. However I'm not here to brag just let some know it is possible if your conditions are right.

Any 4S users able to upgrade without paying the extra $250?

Well, I think I can -- but I didn't place the order yet...
It has me perplexed though, because I got my 4S this past March. I've only had it for 6 months. I have an ATT Family Plan. The other phone is a 3G, and I knew it would be eligible, but I didn't expect my new 4S to already be eligible - not without the early $250 upgrade fee... But I keep going through the checkout/cart process, and the last page before paying, on my line, for the 4S, it shows only the $199 and the $36 activation fee as the charge.

And I have logged back in several times just to be sure and it shows me this:

APPLE IPHONE 3G - ELIGIBLE - Great news! You qualify for an upgrade with a new 2-year commitment.

APPLE IPHONE 4S - ELIGIBLE - Great news! You qualify for an upgrade with a new 2-year commitment.

Now, I've had the ATT account for a long time, but I had the other line on Verizon till March when I added the line back to ATT and bought the new 4S, and put us on a family plan. But I'm serious; it's not showing an 'early upgrade' option for my 4S; it's showing the upgrade as you see above...

I am afraid to call and verify, for fear they will say it's a mistake. Who knows?

It would be good for both of us to get a 5, but we were just planning on using the 3G upgrade to get one 5, and keep the 4S until we could upgrade it as well.

Maybe it's because I pay a lot, am not late, and have a family plan with two iPhones on it, and have a longstanding account? I don't know, but it appears I am eligible for a full upgrade with renewed 2-year contract on either phone, WITHOUT paying the $250 upgrade fee for the 4S I've only had for 6 months.

If no one believes me, that's fine... but that's how I ended up here -- trying to verify why I am really eligible for an upgrade when I have only had the new 4S for 6 months.

I can paste the printscreen from my account web page as proof if someone wants... will just have to blackout my number/name... Just saying.

I will repeat - this is not a 12-month, 18-month, or 24-month thing.
I've only had the 4S for SIX MONTHS.
 
So i've read this thread and many others and tried the "loop hole" that might exist for customers with ipads w/data plans. Since my main line was not eligible, for fun i clicked my ipad "line" and was given the page saying it's eligible at full discount. I was able to choose my iphone 5 (black 16gb) and keep the "all current rate plan settings" (mobile share with 2 iphones, 1ipad). The only catch here is before i activate the phone when it comes i have to take it to the store to activate it as my main line, if i activate it as my ipad "line" it will automatically throw on another smartphone to my mobileshare plan at $45 instead of $10 for the ipad. Im sure this is an unintended glich in their system but it certainly works. If when I go into the store to complete the swap they give me any problems I still have 3 days to cancel the whole deal so I'm not on the hook.
