Anyone else. -- I misspoke. We don't need the government to nanny us. Outlawing opiates hasn't stopped people from using them. There would be intravenous drug users whether the government allows it or not. The difference is when it's illegal people end up having to do much more dangerous things in order to get their fix.

I don't think you're going to find too many people that agree that we ought to legalize opiates for recreational drug use, but that's a topic for another thread.
 
Every pesticide label I have ever read has the following on it: "It is a violation of Federal law to use this product in a manner inconsistent with its labeling." That includes Spike 80 DF, which is what news reports are saying Mr. Updyke used.

That's right folks - he allegedly broke FEDERAL law. That means the EPA might be going after him for soil and water contamination and illegal use of a pesticide!
 
Auburn tree poisoning suspect released from jail

AUBURN, Ala. — The man charged in the poisoning of two oak trees at Auburn's Toomer's Corner has been released from jail.

Lee County Sheriff's Major Tommy Carter said Friday evening that 62-year-old Harvey Almorn Updyke Jr. has posted bail, which was set at $50,000.

Police charged Updyke with first-degree criminal mischief on Thursday for allegedly using a tree-killing herbicide to poison the oaks. His release came on the eve of a scheduled rally at Toomer's Corner, where fans traditionally celebrate big wins.

Man accused of poisoning Auburn trees indicted

OPELIKA, Ala. — The Alabama fan accused of poisoning the oak trees at Auburn's Toomer's Corner has been indicted by a Lee County grand jury.

Court documents posted online show the grand jury indicted Harvey Updyke Jr. on four felony charges and two misdemeanor charges.

The 62-year-old Updyke faces two felony counts of first-degree criminal mischief, two felony counts of unlawful damage, felony vandalism or theft of property from a farm animal or crop facility and two misdemeanor counts of desecrating a venerated object.

He is scheduled for arraignment on May 26 before Lee County Circuit Court Judge Jacob A. Walker III. He has a tentative trial date of June 20.

The trees are at Toomer's Corner, where Auburn fans have traditionally celebrated wins.
 
Man, that is kind of sad. Doesn't seem like he is playing with a full deck. But I don't think he deserves to be in prison for 10 years for killing a couple of trees.

He's not going to get 10 years, people! The original article says he could be sentenced to 1 to 10 years. Unless the a*hole has a multiple-felony criminal history, he will get a year or two at most, and be out in half that time.
