Again... Look at the phones on the market pre iPhone and look them now. Tell me that they didn't copy Apple.

Apple is a major part of the turn to touch, no one argues that. When touch is established as the new norm what are companies supposed to do, make phones that people do not want? (to be sure, lots of people still want phones with keys but still).

But thats still not the question here. The question is, now that touch is de facto established how do we go about to do A, B and C? As for swipe, Apple was not first.

Anyway, Samsung can still use swipe. Its more likely something similar to rubber banding when pictures are not swiped across that they got slammed for. How do i know this? The tab running 3.x is fine, and it has swiping. So yeah.

If everyone else is doing all the innovating, why do all of their devices look and operate like Apple's? It seems to me as if Apple is leading and everyone else is following, and Apple is asking for its investment in R & D to be honored by some period of exclusivity with respect to sales of devices it invented.

Of course, some people on this board would prefer for anyone to be allowed to produce devices that look and feel exactly like those that Apple has created, rather than create something more unique. What these people do not realize is that such an approach actually stifles competition and innovation, because it does not force companies to produce and market new ideas, and it eliminates any incentive to spend any time or money researching and developing something new, since it would only waste resources and give no leg up on the competition. So, like Samsung and HTC, instead of bringing us the next great portable consumer computing device, Apple should just wait until HTC or Samsung come up with it, and then copy them.

Oh, wait, that's right, neither of those companies has ever come up with an industry-changing device like the iPod, the iPhone or the iPad. Why? Because copying others is how they have achieved their success.

i have a htc flyer and can tell you it is worlds apart from the iPad and works 10 times as well.

Back to the issue: swiping with your finger is an intuitIve way to switch photos but it is not the only way. Before the iPhone, no one built a device capable of such gestures and apple invented the touch screen finger swipe to switch pictures. Since this a specific idea, and a completely unique one at the time, they were granted a patent. It seems that other manufacturers don't want to think outside the box as apple did in 2007. They simply used a patented technology. That is Illegal. Wether or not the patent office had the right to allow this patent is a hard question to answer, but in 2007 thIngs were much different.

Nevertheless, about 10 years from now apple's innovation and research will be available for everyone to use!

There were plenty of phones "capable" of such a gesture prior to the iPhone. ;)

It appears you didn't read the actual patent either.
Apple didn't invent swipe on a capacitive touchscreen, they used 5 existing patents (none of which belonged to Apple) and created the swipe gesture out of them. A very narrow one at that.

Read the previous patents cited in Apple's patent.
The fact that it got past an examiner is amazing.
 
Lol...i find it hilarious when people say this. You really believe that a single phone is going to give apple "a run for it's money"? No. The GS2 will sell 5 million in a year...the iPhone will sell 20M in a quarter.

The GS2 is going to be another android phone that gets a few million sales then disappears like every other android phone.

I didn't say it was an iPhone killer. I said it was a very good phone and Apple is afraid that it will infringe on iPhone sales. If it's so insignificant, why the fear by Apple and the iPhone fanatics? Don't they like competition?

They like competition as long as there isn't any... thats why all these little lawsuits keep popping up.

You're assuming its fear. In your mind Steve Jobs is sitting in his office biting his fingernails in sheer terror of the Android onslaught. I think the more logical explanation is they were granted patents which they are trying to defend.

Of course, the image of Jobs in a corner in the fetal position rocking back and forth saying "please stop android, please stop" makes for the better hollywood storyline...:rolleyes:

Unfortunately for you, the judge thinks theyre product is unique enough (minus a minor thing present in 2.x but not 3.x). Second, this thing is hardly something that apple spent lots of R&D on (its a neat thing though, if i get it right).

Further, what you dont get when you go on your "patents are needed for innovation"-parade, is that innovation often times takes place at the ground, not at the top. However, due to the current system the man on the ground has no chance of protecting his innovation from Big C. With Big C in turn having tons of broad patents on everything between Alpha and Omega they can easily kill off any competitor. Heck, the mere fact that pretty much every single Silicon Value start-up is slammed with a law suit within months proves that theres something wrong with the system.

Its pretty much impossible to day to develop anything without infringing on something, and theres no way of knowing until you get letter in the mail (which itself does not need to say what you are doing wrong, just that you are doing something wrong - which you cannot easily check).

It's lighter, thinner, faster, better screen, better camera and so on than an overpriced iPhone 4.

Apple knew Samsung would be the new leaders in the smartphone markets if they didn't stop Samsung.

Anyway, Samsung has already changed the swipe behavior so the Samsung Galaxy 2 is already legal to be sold again :rolleyes:

my friend has an iPad 2 that no joke, cannot compete with my flyer on any level, the flyer works better and is more popular.

I really cant wish the life out of someone, especially not someone as visionary as him; one could pray for some humbling near-death experience though, some divine intervention of sorts.

What if someone changes the GUI with a free App to change it back to the original swipe behavior. Must Samsung block that App? :rolleyes:

The same people who are bashing the iPhone are the ones who swear every phone that comes out every week is going to be the "iPhone killer". If these phones are so amazing, shouldn't iPhone have been left in the dust a long time ago? I mean, now the hype is for the GS2, which will be a highly successful phone, but will come nowhere remotely close the iPhone4's success, let alone the iphone5.

It's the same thing with Android's "openness". Are any of the manufacturers claiming that their phones are open source? Nope, but you better believe the forumgoers will use that as the number one reason why android is better then ios...

My friend and I both have flyers they work better then the iPads around here yes its an observations but it is based of true facts, and things are labeled as iPhone killers because they are superior to the iPhone thus it should be an iPhone killer.

I'm sorry but Apple may have lost in this one.

Winning as decision on that patent is not not winning at all.

It was the only patent that Samsung and other companies can easily patch and remove.

it would only be a win if this app/feature was the selling point of the phone.
