Yeah? How do you figure? When I restored, iTunes downloaded the update directly from Apple's servers. I was never even given the option of paying. How is that in any way "stealing?"

i am not surprised that apple released it at after 0000 us time. It makes sense to do it after the usa is asleep, then the downloading is phased between the rest of the europe, asia, oz then the us.

Once apple had realized that the servers could not manage the iphone new, old, mobile me, the ipod touch 2.0 plus the normal day job (the worlds biggest music store) all downloading at once it makes sense to control when people can download.

Is a day really that important???? really???
