I'm not one of those that jumps on to "conspiracy theories" type of stuff but for some reason something does seem to stand out way to much here...

Too many dumb people in one story and a giant corporation that gets nothing but free hype.

The problem with this country is too many conspiracy theorists. There are "too many dumb people" in this story just because a large percentage of the population is dumb. As proof of this I offer to you the fact that there are actually people who believe this is a conspiracy.

Jon Stewart needs to do an updated story after trashing apple with limited info. I'm probably just feeling suckered and bitter myself after almost being swayed by his bit, but with this news he should really do a second take.

Jon Stewart's show isn't a news program, it's an entertainment program. More people should realize this.

I was once on a general grand jury for 6 weeks where you listened to police evidence and voted if it should go to trial or not. We would hear on average 15 cases a day or about 80 cases a week. Every single one of these criminals were dumb... hard to believe how dumb. We even wondered if all crooks were that dumb or was it only the ones that got caught who were dumb. In fact, many of these criminals came in before us and confessed their crime to us... told us they did it.

I don't buy the argument that sales of current iPhones were hurt by leaking the phone. It's pretty common knowledge that Apple refreshes the iPhone annually during the summer and sales always slow during the time leading up to the summer.

Edit: Osborne effect is already in play based on Apple's predictable release schedule. The leak will have little if no effect.

It is common knowledge that there will be a release (I am not even sure it is for many people, but let's say it is). What you normally don't know is what the improvements will be. You are left guessing every time based on rumors - that's why sites like MacRumors exist - and you are making an uneducated guess. With Gizmodo posting the photos, you know what features the new iPhone will have and you are making a much more informed decision.

Considering American beer tastes like camel's urine and with the same consistency and temperature, it doesn't take too much imagination to assume he was commenting on what a good cold German beer actually tastes like. :D

Actually, Samuel Adams is not a bad brew. Lone Star's okay too. Lagers generally. I'm talking about what passes for beer in most bars, Bud, Millers and other such flat warm dishwater. I seriously gagged the first (and last) time I tasted a Millers on tap. Even Fosters, my god what the hell have you done with that? Blecch. We send you something good and you ruin it. It tastes nothing like the Australian stuff.

I can't remember seeing Fosters in OZ for years. Last I heard it was a name brand being sold overseas only. Pity as it was pretty revolting stuff from memory. :p Glad to hear the guy hasn't lost his job because he lost his phone.:)

Yeah! What-up with that?

Do you bring your cell phone when you go places? Honestly, that's quite an unintelligent thought.

No! Not prototypes! He needs to be FIRED! Where's Trump when you need him! Plus, this story is old and there's the new mac pros coming... what about those? This site sounds like a broken record!

Don't you guys get it. This was an honest lost and found case. Apple directed all the chaos in exchange for free publicity. You know why Apple is going to drop all charges at the end? Because they aren't even after the Vietnamese who also leaked a later model.

This is the case of a rotten apple that want to stand out. A case where the rotten apple wish to be purchased and eaten. But customers knows that a rotten apple is a sour disgusting apple. Apple being the rotten apple, literally.

Claiming that the leaked iPhone cause Apple to lose million of dollar is an exaggerated statement like how the RIAA suits everyone that downloaded music and movie from Limewire.

I'm unfamiliar with this term. What does it mean?

Apple directed all the chaos in exchange for free publicity. You know why Apple is going to drop all charges at the end? Because they aren't even after the Vietnamese who also leaked a later model.

First, I was unaware Apple controlled the police in vietnam. Second, I was unaware Apple is the prosecutor in San Mateo County and thus decides whether to drop charges.

This is the case of a rotten apple that want to stand out. A case where the rotten apple wish to be purchased and eaten.

Is this some sort of metaphor? What does it mean?

Claiming that the leaked iPhone cause Apple to lose million of dollar is an exaggerated statement like how the RIAA suits everyone that downloaded music and movie from Limewire.

So Apple should just publicly announce everything it plans to do as soon as someone thinks of it, because there's no way that doing so could possibly cause Apple to lose money?

I'm guessing, by your attempted metaphor, that you often find that people don't seem to make a lot of sense?

Actually, that's far from true. While I'm certain all students know it either directly or through friends, and all techies and people generally aware of upgrade cycles, I'm amazed at how many people I run into weekly who hadn't a clue (and some still don't) that aapl's on a yearly upgrade cycle.

Apparently I must hang out w/ a more informed crowd than you. Or all your friends just woke up from comas. :D

Exactly what new features were revealed by seeing a case?

Most of the new features we know about were announced w/ OS 4.

Try again...

1) double resolution screen
2) front camera
3) rear camera flash
4) bigger battery
5) A4 processor
6) noise-cancelling mic
7) design (shape, rear glass, etc.)

None of these were "announced" w/ OS 4.

Further, we learned what is NOT in the phone and what didn't change.

1) Nobody has confirmed this with the found prototype
2) This was revealed in the OS 4 code
3) Ditto
4) Concede...this was new
5) Confirmed, but already assumed from iPad
6) Concede...this was new
7) Not a feature

And nothing is final, we don't even know all of the OS features, so you can't say we have learned what didn't change.

Not too bad? Maybe 300K to 500K leftover unsold phones which otherwise would have sold for aveage of say $200, now sell for $100. So, $30M to $50M? Chump change for Gawker, right?

False for average phone sale. The phone is $599 - $699 unsubsidized (http://www.engadget.com/2009/03/18/...idized-iphone-3g-with-no-commitment-required/). If you are saying average of $200 because you can go to ATT and buy one, ATT pays Apple the remainder (phone is subsidized, you pay the remainder over the length of your 2 year contract with them). I cannot really comment on the phones not sold, but given they sell between 8-9 million (http://en.wikipedia.org/wiki/File:IPhone_sales_per_quarter_simple.svg) a quarter it is safe to say you are way off and it is close to 2-3 million phones. So doing the math using 50% the lower amount on everything (1 million phones at a $599 price point; saying they lost half their sales for only one month). You're looking at a loss that is much, much, much higher than what you estimated $599,000,000 to your $50,000,000. (By the way, that is only averaging 3GS 16/32gb models. Including the 3G model would be much higher.)

Anybody who thinks Apple is loosing a dime on this is very naive.

1) a higher res screen was confirmed, though the specific res isn't clear
2) 3). There was no way to tell if os 4 code applied to iPhone, ipod touch, the next iPad, or some other device. Also, these were not announced features.
7) of course the design is a feature. Don't be ridiculous.

And you concede 4,5,6 so I guess you concede that secrets were revealed.

"PRICELESS"??? Really? IT IS A PHONE!! not the holy grail!

[...]but, you are taking this way too far calling this thing "priceless". it has a price...probably $221? ;) who knows.

Are you kidding? Do you know how expensive prototype electronic components and plastic enclosures are? And a ceramic / glass case element... do you think that Apple just buys a bunch of those from Home Depot?

Also, try to think about the amount of money it takes to design an test a prototype phone. $221? That is, what... a day's pay for one Apple hardware engineer. Try adding a few zeroes to the cost of the phone. $221000 is more realistic.

I tested computer audio interfaces / sound cards for a few years. When we went to trade shows and displayed "upcoming products"... those single units were typically valued at ~ $80k at customs during shipment.

False for average phone sale.
AT&T would have to subsidize the full retail price for that which I would guess they don't. Maybe they do. If Apple had time to adjust production, they could end up with the same number of leftovers as they originally planned, a near-sighted wash for Gizmodo. Far-sighted, costs from the adjustment could still add up to a pretty penny. Might find other companies joining a suit for their damages.

Yes, we must have seen different shows. Here are some other quotes from people who saw the show that I saw:

< list >

Yes, fawning.

Wow... you mean a bunch of Internet news sites and blogs (who want to capitalize on Stewart's popularity) would publish sensationalistic-sounding, eye-catching headlines and articles to attract readers????

Websites wanting more clickers to gather?
No way... i've never heard of such a thing!

There is absolutely no comparison between Stewart's sarcastic jabs at Apple and the brutal skewering which typically goes on there. [the CNBC series was a masterpiece, and it's amazing that Jim Cramer still has a career.]

Ride Jon's coattails all you want. I feel confident if he ever read some representative samplings of your "writings" he'd distance himself from that mindset in a heartbeat. [and with these recent developments in the case, i'm sure Apple is probably already back in his good graces. So... i think the cow is pretty dry by now (not that that'll stop you of course).]

Edit:

Some (specially) selected "Apphole" quotes, to counter all the negative spin...
I like Apple products.

Every time they come out with something new i get it.

I've been a faithful Apple customer since the early eighties.

So you can image how excited i was when i read that the tech blog "Gizmodo" had gotten their hands on a prototype of the new iPhone that's gonna be coming out this summer. Oh man that thing looks so cool.

Although the thing about Apple's cops: they have the coolest tazers.

You know i love you guys right? I love your products... i use them all the time. I even love your stores, so futuristic... they look like futuristic Swedish hospitals.

Well look in the mirror man. Or actually, just look into the screen of your iPad before you turn it on, 'cause it is surprisingly reflective. It's really beautiful. [did you guys do this?]

And you know that new iPhone with the front-facing camera and video chat? Could you send me one of those a little early? [it looks totally sick.]

Announced in OS4 by whom? Apple? There are many features in the OS that aren't used (not to mention that we have the iPad too).

1) Improved display was confirmed
2) Front-facing camera was confirmed (until now it was merely a hint - check it here: http://9to5mac.com/node/15798)
3) - minor -
4) Better battery was confirmed
5) A4 was confirmed
6) Noise-canceling mic was confirmed
7) Design is a feature (important one too - many people I know dislike the curved back)

If some of those features were revealed in OS4, it still wasn't sure that the phone will have them. Given the small list there, you are much more informed than before. While I am not saying this will affect every person out there, some people will decide to wait, based on those confirmed features.

Have the police talked to anyone else?

Have they talked to Chen or Lam at Gizmodo?

Has anyone "lawyered up?"

We're still seeing PART OF THE STORY.

We don't know (I don't think) what's been happening since the seized equipment, have we?

Many more pieces to this story seem to be forthcoming.

Talk to whom? They already know pretty much everything.
I don't think they need to talk to Chen - what he did is on the internet.
The seized equipment will probably serve as proof to what we already now.
