i have gone to the 5th ave store and specifically asked about buying an unlocked phone. they say that the part numbers for the unlocked phones will be different and won't be available until some unspecified time in late november. they say that the phone isn't truly unlocked and that it is an att phone.
i dont knw what to believe anymore because none of them really seems to know and are so adamant it will not be considered an officially unlocked phone. figured i would just wait until they announce the unlock in a few weeks.
 
Guys, there is a simple solution to clear this uncertainty.

two facts:
1. When you purchase an iPhone you can return it back in 30 days and get your money back.
2. We know that the unlocked models will be officially available by the end of November.

I wonder what will happened in a case you purchased a "device only" model, activate it and getting the unlocked message. Then call Apple support tech line and ask their confirmation that you have an unlocked model !!!
Ask them to send you a confirmation email that you can keep.
If they will not cleat this thing for you or tell them that you will return the model and would like to get your money back.

I don't see any reason why you can't call Apple and ask them about the status of your Model. You can explain that you purchase it knowing that it will be unlocked and you would like their confirmation that it will remain like that.

With the 30 days money back option, and the fact that within days we will have the official "unlocked" phones for sale I have a feeling that Apple will not ignore your request and will deal with it with care. Apple is a smart company and I am sure they thought about that option. They probably counting on the fact that no one will do it, the same as if you call their sale line they will claim that you can't purchase device only, BUT they don't know what its going on in their shops :).
They always leave an option if they want, you just need to use it :)

Just talk with the apple tech support :)

They confirm that I have an official unlocked IPhone 4S and it will remain like that.

They document my concerns and sent me a case number via email that I can use in the future if something will get wrong.

As expected, Apple was ready to handle this case.
I love Apple and their support. I guess sometime they force us to get their products in the hard way so we will keep talk about it (a lot on the web) while making apple products more attractive to reach :)

I was able to pick up my 4S today and purchased device only. I got the "your iphone is unlocked" message but having issues. I have a diff thread in the help forum here since I don't want to hijack this thread.

But I can confirm the Apple store will sell you a device only if you are quick enough to reserve one the night before. They didn't ask for any of my AT&T info and I activated the phone at home.
 
I went there and they told me to book the 4s from 9pm (for the next day)
After many attemps (one or two hours),

I managed to display the purchase page but when I selected the store, everything was gone. There may have been some contract 4s left in some other shop but that doesn't interest me.

When reserving an iphone online, do you have to sepcify online that you would like a device only, or do you just tell them that when you get to the store and are about to purchase the phone?
 
If they are already selling unlocked iPhone 4S in retail stores when requested specifically by the customer, why are they still saying "Coming in November" for nine days for unlocked iPhone sales at online store? It really doesn't make any sense. If you sell something at one place, just sell it at every place.
