Apple could only apply the promotion to "older qualifying macs" and "older qualifying ipods" once the new macs/ipods are released can't they?

They probably won't do it with new Macs. Those will most likely still be able to combine with current-gen iPods for the rebate. However, if new iPods are released before September 15th, a new rebate excluding these iPods will be given.
