So which is it? First you people say Gizmodo isn't telling the truth...now you say you make substantial judgments based on their 'facts'.

Where did I say that? Many of the things they have said may not be correct, but what matters in determining the theft is how they acquired the phone.

The judgement is rather simple and supported by law. Gizmodo are guilty of theft.

If disclosing their trade and design secrets to the world 3+ months in advance will not harm them, why would Apple expend such unbelievable effort on keeping secrets in the first place?

Why have their own Gestapo? Why sue bloggers? Why expend the money and incur the public ire if there is no massive business advantage?

One of the important factors in Apple's success is leaving the public stunned and the competition bewildered on launch day, every single time. If they blog about their prototypes, (or a criminal like Chen does it for them,) they have lost that factor. The cost to them is off the charts.
 
But then (not taking into account any legal matters), wouldn't you be skeptical to have actually acquired an iPhone months before it comes out despite how legit it may appear?

Common sense would have you believe that, however, after reading this thread and the other one on the search warrant I believe common sense eludes a great many of posters here.

Well I find that a little hard to believe. Giz throwing $5k to someone surely seems to me they had a pretty good idea it was legit. Again, I could be wrong here but it seems like the intent was to acquire something legit (illegally) and exploit it. Herein is where the law was broken... imho

Well $5k tells me they had serious doubts. I'm pretty sure whoever sold it could have gone for much much more.
 
Think of it this way.

So tell me this, do you honestly believe the fact that they reported on this information that they are suddenly criminals? Sure, they may have opened the door wide for a civil lawsuit. But come on, they are NOT criminals!

I am not on Apple side, but on California old law yes they are. I am sure they asked legal council but here is where it gets tricky, NY laws may not consider what Gizmo did illegal, I don't know enough about NY laws and their Theft law to be sure, but in California they have problems.

There is a distorted reality anytime you are around any sort of 'brand loyalists' Laws are interpreted all the time...usually in the direction that supports the person doing the interpreting.

I bet most of you are "criminals" too by the law...having sped, shoplifted a grape and popped it in your mouth in the produce aisle, double parked etc. Nobody here is perfect yet you chant "burn them" like some hypocritical Apple sycophants.

That could very well be true, though he was turned down by Engadget and no real journalist would pay to see the device as they know it would be a felony.

Giz were the only ones willing to pay up, so the guy took what he could get.

Well, I should have qualified that.

As I said before, in the USA you are only a criminal if you can't get lawyered up enough. Everyone else hires attorneys to misuse the law to protect themselves from having to pay for their crimes.

We'll see where this one goes.

See you keep spewing this garbage. What did Apple do to piss you off so much. No one is "sticking up" for Apple. Most people are discussing the laws as it pertains to this situation. This is not Apple's doing, the DA and the police decided to pursue charges. The most Apple can do is file a complaint or file a civil lawsuit.

I wrote already about this, but California theft law does show that in their eyes yes they stoled. Every state makes the law as they see fit.

Now the key to the case is if a judge will uphold this old state law or move in a different direction.

I'm not sure why you keep harping on "blue" laws (which address things like selling liquor on Sundays, not theft) and "old" laws. You seem to think that California is an outlier and that (at least) Texas and Florida are different.

Umm apparently all you have to do now is get out of college and blog about the stolen techno toys you bought and profit from the ad revenue. That makes you the same as Walter Cronkite covering the Nuremberg trials.
