Exactly and this has been extensively covered, but people still keep saying the "iPhone patent" is proof the iPhone invented multitouch (and neither did fingerworks). In fact, the spreading/pinching of fingers to zoom in/out is not even hinted at in this "iPhone patent".

Though it's clear that Apple and Fingerworks (approved patents, patent applications) have several patents on multi-touch methods, you're right - it doesn't mean they didn't cross over into Elan's patents.

Until either one of them disclose the disputed patents we won't know anything. And this lawsuit won't show up in this quarter's filings for Apple since it was in April.
