I'm not trying to act all high and holy here but if I was in this situation I would take the phone back to either the carrier or to Apple if you're close a store. Wouldn't think twice about it really, it's just the "right thing to do".

Probably the best comment in this thread. This whole thread has totally become an PETA type thread where everyone is stating what's wrong and right.

Do whatever you want to do. You'll be praised for 2 seconds if you return it and hated for 2 seconds if you don't.
