I would suspect it was a kid or teen, have you tried going to the local school? If you want to return it that would be the first place I'd go.... but under the circumstances I don't think I'd want to give it back.

Yeah I'm not sure I want to give it back to some guy who broke into our yard. The tire slashing thing took place a couple of days ago and caused my parents to pay for new tires. So if this does happen to be the same person vandalizing property around my neighborhood, I don't want to just let him off.

Oh no, if someone broke into your yard I wouldn't want to either, but knowing me I would start to feel bad and end up trying to find the person.... but I'm pretty much the only person in the world like that  Feeling bad for something they did, meh.

But if you feel okay with keeping it, go for it! They probably deserve it!

If they broke in and used your pool without asking keep the phone. It's karma.

Hold onto it for now. There is no point in taking it into the police. Quite frankly they don't have the time or money to worry about someone's phone.

If your story is true (this is the internet after all), I would suggest that after some time has passed, you can feel free to wipe the phone and keep it or sell it. If you really did find it on your property and no one comes back for it, it's clearly been abandoned.

Honestly, if these facts are true, no one should come back. It would be absurdly stupid to do so. A phone, even if it costs $400 to replace, isn't worth the hassle of being sued for trespass (which you can do).

Could not the real owner of the phone report it stolen so that when she tries to sell/activate/etc it the IME would come up as stolen? I do not think I would want it.

It sucks but you can't do anything. If that person really wants the phone back he/she will knock on your door and say "I'm sorry I went inside your pool, can I haz ma fone bak?" But no one has the balls to actually do that so the iPhone is yours for their stupidity. Calling Apple and taking it to the police will not get that phone back to the person. Trust me.

No US carrier actually marks any IMEI or ESN as stolen. So that's out of the question.

Really? that kind of sucks.

Actually yes they do. My friend and I had our phone stolen at a bar, I have Sprint and he has Verizon, we called our carriers and both reported the phone's ESN as stolen. If whoever that iPhone belonged to calls his carrier and reports the phone as lost or stolen, the OP will not be able to activate it at all since the computer will show it has a bad ESN.

Wow this thread just keeps getting more interesting....in the beginning you said you didn't know anything, now you say "some guy" broke into your yard. OMG!

Seriously, this phone could be stolen. If it is you do NOT want to be in possession of it. Period. Anyone here that advocates keeping stolen merchandise should be shammed with hot wax and left to be flogged by the opposition.

Honestly I would figured out/take a guess at which network it was on, and drop it off at a local store and let them deal with it. I would not give them my name or anything, just place it in an employees hand, "hey I found this, see that it is taken care of" or something and leave.

Yeah, it amazes me people are assuming that the person who was trespassing and maybe up to no good actually is the legal owner of the phone. It is very possible that the person who dropped it stole the phone from some one else. After all, he's breaking into places, there's already precedent he's more likely to be some one who would do that.

This is probably the best advice I've seen on this thread.

It honestly doesn't matter if it's a lost phone. It was lost by someone trespassing on your property, and they're just SOL.

If some guy comes around and says that he's "Kyle" and that he wants his phone back, you have a few options.

1) Give him his phone back.
2) Tell him that you'll give him his phone back and also report him to the police for trespassing. Does he still want his phone back?
3) Tell him you don't believe him and shut the door.
4) Tell him the phone fell into the pool and doesn't work anymore.
5) What phone?
