If anything was saved on it, couldn't you just take the sim out, put it in your phone and make a call to someone on the list?
 
Call Apple Customer Service. If the owner is a registered owner, they may have his contact information. That's what I did when I found a locked iPod touch. They ask for the serial number located on the back, and then they tell you if the have the contact information. It's your best bet.

They should just let everything open for anyone to view.

I had a passcode on mine, plus had preview of texts off, and my ringer was silent with no vibration. I just texted my iPhone through MobileME with 2 mins of sound (despite all sounds and vibration settings off on my iPhone), and the screen alerted the person who had it with my name, apartment, contact number, and e-mail. That is how they were able to get it returned to me after I lost my iPhone.
