Ahh... I wouldn't worry about it. Huge companies won't notice one stray system 'cause a few years ago I went through a tiff with my display. Kinda swapped out at least 30 CRT's in the space of 8 weeks. Eventually something went wrong and instead of receiving one replacement, I got two 22" Mitsubishi CRT monitor and if you folks know about pre-press CRT's with the hood and all. You'll know those are heavy fookers!

Mitsubishi never worked out their error. When they failed inside their 3yrs warrenty I got them both replaced too...
 
I would call Apple to return it. Just because I want a peaceful mind.

Who knows, they might even reward you with something else.
 
i'd get the CSR and CS Supervisor's statements in writing and faxed to you.

then you're good. :p then if they find out instead of going after you they'll fire those two.
 
The sales rep said that they couldn't force me to return it... so I'm interpreting that as a send it back if you want to kind of thing.

But you guys don't think they could legally go after me for keeping it?

If you were in the UK, I believe that under the unsolicited goods act, you should tell them of the error and that they should collect it. Then after 3 months if its still not collected - its yours.
 
So... why do you still have 2 if you told them you had a 2nd one that you didn't pay for?

Did they let you keep it?

Your story doesn't make a whole lot of sense as it stands right now... please elaborate on it.

I got the second one in the mail on monday, it's Wednesday night right now. I told them I would return one of them, but I wanted some time to pick which one I want to keep (The first 2 MBP's I had were defective). I will be returning one of these computers by Friday, but I'm still not sure which one. If you're interested in my dilemma you can search the forums for "backlight bleeding and black levels". I took some photos of the two different screens and their unique problems. I'm waiting for a certain person at apple - the woman I've been dealing with throughout this whole defective macbook pro debacle - because I want to speak with her before I return either of them.
I hope I cleared up any confusion :D

The sales person told you they can't force you to return it ... sure ... but if you choose to keep it, they can charge you for the MacBook Pro.

Why do you think they asked your credit card information again before shipping out the replacement MBP?

Apple's policy on matters like this states that, unless you can show you have done everything in your power to contact UPS (or whatever pick-up service they're working with where you l ive) and get the thing picked up, you have to pay for the device.

What does one company care about one small MBP? They don't. There's no point to them. Apple just won't care. The "safest" thing to do would be to return it, but then again, you could of had a free MBP. I know this goes against many people's morals, but it's not like the OP tried to argue his way into getting another MBP. The Apple rep told him he could keep it. I know it wouldn't hold up in court, but it would cost apple more money to go to court than just to let you keep the laptop.

Again, you getting confused by my story.

All machines have been sent back that are attached to RMAs. The machine that is still on its way looks like a replacement for one I sent back. There is no charge on anything for this machine, as they already received the collateral for it, the machine that I sent back first (except I wanted a refund, which has already cleared).

On my order # where this stray macbook is listed, it literally says 0.00 for the charges.
 
I doubt anyone's going to give you legal advice. For starters, we don't know what state you're in. Secondly, no one's going to want to risk malpractice for giving you free legal advice on a forum with limited facts without the ability to ask followup questions in detail.

Sounds like your conscience may be bothering you a bit about it, or the title of your thread would have been "Apple F#@$ed Up, and I Scored a Free Macbook Pro!!!"

Send Apple an email telling them what happened, and ask them to pay for return shipping. Even if there are no consequences from keeping it, do you want to be looking over your shoulder for the next six months, year, whatever, wondering if the sheriff or process server is ringing the bell? Getting a phone call from your Mom screaming over her newest credit card statement? Peering inside of your mailbox to see if you've got any certified mail from California? Wondering if Arnold Sc...okay, maybe that's a bit too far.

Either man up, do the right thing and document your efforts, or consult a local attorney to find out your rights and all possible ramifications. Or, sell it for beer money, and spend the next year or two looking over your shoulder. The choice is yours, and so are the consequences.

I'm going for a an email from that supervisor for written proof that this laptop was given to me free of charge for my extreme inconvenience.

The phone conversation I had with two reps about this situation is on record and recorded by Apple and both reps seem to think that I should be able to keep it with no ramifications.

After I get written proof, I'm not going to be looking over my shoulder because I can call the sales team, present them with the evidence, and they will cancel the charges. It would be them that would charge me again anyway. (This is what my last rep advised that I talked to last night.)
 
Well... according to the law, if a company sends you a unsolicited item, you can keep it without ever returning it. Is the company's (Apple) responsibility, not yours.

Edit: sod it, hold onto it for a few months and if you hear nothing it's yours. No one is going to come clammering back after a single stray laptop.

"Extreme Inconvenience"?!? Well if thats so, alot of us on here should be getting free laptops...I've been to Hell and back w/ my MBP order. I know I'm not alone either.

I'd just ask if you can get any freebies for all the trouble and great confusion they have caused you, as well as your honesty for getting back to them about the error.

I'd try get Apple Care out of them if I were you.

I probably would, but I don't have it yet and Fedex might have delays because of weather is Texas. :(

She'll give me something for d*** sure, I'm not letting them off scott free if they take my free gift away!

Just keeps getting more and more involved and more and more convoluted.

Wouldn't it be easier if they just let me frickin keep it?

It could be defective for all anyone knows. I'd take a free machine even if it is defective. :)
 
There is no evidence on this thread. Apple cannot simply look at this thread and know who I am unless MacRumors gives them my private info, which would be illegal?

Actually, if they took some sort of legal action against you they could most likely have MacRumor's records subpoenaed and obtain your information.

Keep in mind that this is also an interstate case due to the fact that you have to ship it, so if they were to pursue criminal charges for theft or some sort of fraud, they would likely have to get the FBI involved.

Nothings illegal anymore after the Patriot Act.

Um, yea...this doesn't qualify as a national security matter. So Big Brother will have to try something different. So if you add another layer of tinfoil, you'll be protected. :eek:

Seriously, it's a matter of morals. If you choose to compromise your morals, then keep it. I personally consider it to be theft if you do. There is no way that you have been so inconvenienced that Apple owes you a $2000 laptop.
