Nice! All I got for my 1 RMA was a $150 credit (after I told them I didn't want the free laptop case they initially offered).
 
Well, it appears that the foreign lady is going to cancel it before it gets to me... maybe fedex will still deliver it?
 
Called again for the original guy and ended up deciding to talk to another supervisor. Its a lady and apparently she is committed to making sure I have to return that Macbook Pro if it was indeed sent by mistake, despite the recorded conversations I had with the first 2 reps.

What can I bring up that might convince her not to cancel that order if it was a mistake.

Can they legally take it away from me as long as I haven't received it yet?

A. Send it back, maybe after getting a concession for your time and trouble; or,
B. Hire an attorney. And,
C. Quit asking for legal advice on the forums. You don't want it from someone who is not an attorney, and someone who is won't give it to you for the reasons I've already specified.
D. Some of us already advis-uh, ahem, suggested, that you should contact them in writing and in email. You turned around and called them, presumably without a recording or transcription. If you're not going to follow suggestions given already, why are you asking for more?
 
Again, you getting confused by my story.

All machines have been sent back that are attached to RMAs. The machine that is still on its way looks like a replacement for one I sent back. There is no charge on anything for this machine, as they already received the collateral for it, the machine that I sent back first (except I wanted a refund, which has already cleared).

On my order # where this stray macbook is listed, it literally says 0.00 for the charges.

Okay dude, I know you think you got it all panned out but rest assured, Apple WILL track the notebook. They have to do inventory at least once a month and they will notice a serial number that was sent out without paperwork. They at least know who it was sent to, in the case it was you. They WILL and CAN choose to contact you to return it or charge the credit card without notifying you. It's beside the point rather they RMA was completed already and this is just an accidental shipment. Because it is apparently an accidental shipment don't think for one minute you got away with a free xmas gift.
We are talking about a multi-billion dollar company who keeps track of their inventory. THEY WILL FIND OUT. I don't think your parents would be happy if they got charged on their CC.

If you're so confident that the CSR said you could keep it then you should be just as confident to call Apple and speak to another rep or supervisor for clarification. Also as another poster mentioned, Apple will need to put something in writing or send you and N/C invoice for the Macbook, then it's all yours. It ain't gonna happen.

Alright. A couple things have become evident since your first posts.

Judging by your response to the supervisor telling you that you cannot/should not keep the laptop (that is not rightfully yours in the first place), you had every intention of keeping the laptop if it arrived. If you had good intentions from the onset, you would not have had a reaction such as "Son of a B****" and instead willfully helped to return the laptop that was not yours to begin with.

You are posting here in hopes that someone will tell you that you that you will be fine if you keep the laptop and Apple cannot do anything to you. Nobody can tell you that, and by the looks of it, Apple has already begun to be proactive in getting their laptop back.

So what if they deliver it? It doesn't change anything and they will still request that you send it back. And you WILL have to send it back. It may have been a different case if they were never proactive about it or even if it "fell through the cracks". But it is clear now that they do want their laptop back and they ARE aware that they have mistake and are actively pursuing the laptop.

This thread originally began asking if it was okay to keep the laptop. Your post that indicates that a supervisor has already taken action to stop you from receiving the laptop, shows that it is NOT okay - yet for some reason, you are cussing and immaturely complaining about not being able to keep a laptop that you weren't entitled to in the first place.

I am sure apple would sympathize with you more if you had offered to help return the laptop instead of complaining about it.

.. and please. Drop the legal nonsense. You don't need legal advice. If you need advice, your parents should be an ample resource for your current situation.
 
I probably would, but I don't have it yet and Fedex might have delays because of weather is Texas. :(

+1. And if you really wanna be honest about it the OP deserves NOTHING more than the laptop he paid for. Apple's hasn't inconvenienced him, it wasn't even charged on his own credit card.
This world would be so much better if people didn't try to get over or be so sue happy.

Hate to break it to yall, but I've spent probably the equivalent of an entire day on the phone with Apple over the past month.

I have called them pretty much every day and I seem to get nowhere with any of them.

Most of this time was during my study periods because thats the only time I have to call Apple when they are still open.

So... yes I have been very effected by the amount of time required by this crap.

At this point I don't give a crap what you guys say... your all just jealous that I was soo close to getting one for free.

To all that supported me, thanks for the advice.

To all the jealous haters, I hope none of you ever spend this much time on the phone with apple over a frickin macbook that should have been perfect the first time out of the box. If you have had this experience and are still hating because you are jealous, I feel absolutely no sympathy for you.

Send it back, don't be awkward about it, just call them up, explain what happened and send it back, Apple screwed up yes, but just be a good kind natured person, is it really that hard?

And who knows, life may well reward you later on for your good deeds.

apple doesnt owe you anything. PERIOD. try to understand that concept

you think having to talk on a phone for one day entitles you to a laptop? get real. you are in a rude awakening in the terms of time talking to other csr's in other cases

go ahead and keep it. i hope you get nailed for the cost of it and end up having 2 machines that are the same spec wise

If you receive the second machine in error you really should call Apple (again!) and ask them what to do. This is at minimum a $2000 'for your troubles' gift which I think we all know is over the top. Free apple care or Mobile Me? Sure, very reasonable. Free laptop? I think it is obvious that it is unethical.

I also think that you posting this thread asking for advice shows that you know it isn't as simple as "Oh well, might as well keep it," and I'd be willing to bet that you'd feel at least a little bad if you didn't at least try to return it.

In the past, I have had companies send me the wrong item or something like that and when I call them they are like "whatever, keep it, we just won't honor the warranty since we didn't get paid for it." So, you never know what might happen.

Do the right thing.

Excellent post, I totally agree.......First off, the OP's 'inconvenience' is not worth a free 2k laptop. To even suggest such a thing is preposterous and utterly ridiculous. No company gives away free things for 2k, no one, for sending out a bad laptop a few times. The OP is clearly trying to convince himself that he 'deserves' the 2nd laptop for his troubles. But he must know deep down that it is wrong to keep it.

Second, it is possible that an Apple rep could have told him to keep the 2nd laptop, but of course if someone would investigate the matter, he would never admit to having said so, nor would the rep have documented that he said so to the OP, otherwise he'd have been fired on the spot.

I have heard of others getting free laptop bags, jump drives, apple care, but getting a free laptop would be a first.

Really, even discussing what to do and what is right on this board is a bit questionable, because there will be so many mixed opinions that it would really be just worthless to the OP. But right is right and keeping the thing just isn't the right thing to do.

Wow, seriously? I'm not jealous at all, I just think that returning it was the right thing to do and you should have just listened to your parents ESPECIALLY because it was on THEIR credit, not yours, assuming your not old enough to have one of your own.

Oh my mistake, I thought you were a bit older, now I understand that you are probably just a 10 year old kid on the very immature side, if not younger.

I assure you, nobody here is jealous. Everyone gave you helpful advice which involves returning the laptop which is what you did not want to do. You are just mad because you were soo close to getting away with cheating Apple.

No doubt this was a result of a mistake. Even your topic title suggests you were thinking of this possibility. If it comes to your door, just tell FedEx, or whoever the delivery guy is from to "return to sender." You know you already have your exchange notebook, the one you finally accepted as good. Otherwise you are not being as moral as a customer as Apple is being as a manufacturer - despite your complaints about them. Think about it.

Beyond all that, you do have some valid gripes, but it seems Apple did bend over backwards to make it right. Do the same.
