Technically speaking OF COURSE they can tell - if they want to. You don't know what information it's sending, it could be gathering information about the source of the song as well.

Personally, I don't care - I have little totally illegal music (I copy music from CDs that I own), but even if not, I doubt Apple are against CD copies - after all, if they were they wouldn't allow you to do it in iTunes, would they?

It's the same as the cover album feature.

No, They couldn't.

If you DL an mp3 from a torrent it does not automatically tag the file with "illegal download". That file would be pretty much the same as any mp3 you ripped from your own CDs.
