Why would Apple be involved in this? To me it seems as thought it is AT&T's fault because of them being wary of it working well on their network. But it is ridiculous either way.

I can see more of a problem with that than being 3 days behind schedule. You'd probably have a better case as well, I don't see anything about the 2G iPhone that shouldn't make it not able to do MMS.

Except that MMS was never promised for the 2G users.

You know I was just joking right? I have a 3g:D

Edit: I did not really follow the late summer thing all that much. When ATT said late summer, did they commit to a year or country? :)

True, but one would assume that if it can run the latest software it can send a silly MMS message.

I don't believe they ever said late June anywhere. I hope AT&T terminates his service. TERMINATES!

AT&T had no contractual agreement about MMS in the first place. The sue-happy people can suck it.

But the fact that it can run is no basis for a lawsuit since Apple never once mentioned the possibility of the 2G getting MMS:

Thank God there are those who see the need for this kind of hard-fought justice.

Maybe the government should look in to the legal system in addition to the medical system. One just might fix the other. This is just one more ridiculous lawsuit.

I knew this would happen. It's a matter of what they can claim for damages though.

Or maybe the government should legalize random bitch-slapping.

It's lawsuits like this that make me really wonder where our society's priorities lie.
Wow, you didn't have a feature you didn't have in the first place a couple of days earlier, so now you're going to file a class-action lawsuit and tax the system because you are hoping to make some ridiculous, pointless statement, or you just want some easy cash.

I hope this gets tossed out faster than Vanilla Ice's career.

I can't believe that none of you noted the obvious: post Labor Day isn't 'officially' autumn.

    It depends.
When did this Minnesota complainant stop wearing white pants? If he wore them on the 8th of September, his suit (by his own defined parameters) has no merit.

I hope this gets tossed, their AT&T account terminated, and their iPhone confiscated. Like everyone here with a 3g and 3gs, I too waited a long time, now that we all got it why can we move on.

    Where do I sign-up?

    I bought a 3GS for:

Battery Life - ruined by 3.1
    7.2 MBps - i hit 1.2 on a good day
MMS - As of today 1 day of 65 days
    Video - cripples without MMS

I'm paying ETF within a week of a new carrier.

    LMAO. :D
The problem with legalized random bitch-slapping is it will put more of tax strain on your dollar. There will have to be senate oversight committees, a Department of Legalized Random Bitch Slapping, etc.
It will just snowball to the point that it will take years until the first slap. :D

This is where I don't see the government having any reason to get involved in random bitch-slapping.
I don't want my bitch-slapping regulated or subsidised. Keep it private and let the bitch-slapping market sort itself out.
