If google straight up told me I was getting a refund whether I decided to keep the phone or not....you bet your ass I would keep the phone. I would ask for an email confirmation, but I surely would keep it.

Because it wasn't clear - and the possibility was there that they could be charged later. There was no written confirmation that no charge was pending and the credit card had already been authorised. I suspect had they held onto the phone they would have been charged within a week or two, and then when ringing to query this charge, I suspect the response would have been 'sorry but our customer services staff are not allowed to give away free phones, do you have any written evidence of such offer?'....
Whilst it may be lawful to hold on to goods sent to you personally when they were not ordered, the fact of the matter was that the poster cancelled the order 'AFTER' the order had shipped. They had indeed ordered it, but chose to cancel after despatch - therefore Google have no reason to offer the customer a 'free' anything as it was not sent unsolicited to the customer. So for any rep to make such representation sounds like a miscommunication - especially in regards to the haziness of warranty situation which sounds like something they just made up off the top of their head.
