If google straight up told me I was getting a refund whether I decided to keep the phone or not....you bet your ass I would keep the phone. I would ask for an email confirmation, but I surely would keep it.

Because it wasn't clear - and the possibility was there that they could be charged later. There was no written confirmation that no charge was pending and the credit card had already been authorised. I suspect had they held onto the phone they would have been charged within a week or two, and then when ringing to query this charge, I suspect the response would have been 'sorry but our customer services staff are not allowed to give away free phones, do you have any written evidence of such offer?'....

Whilst it may be lawful to hold on to goods sent to you personally when they were not ordered, the fact of the matter was that the poster cancelled the order 'AFTER' the order had shipped. They had indeed ordered it, but chose to cancel after despatch - therefore Google have no reason to offer the customer a 'free' anything as it was not sent unsolicited to the customer. So for any rep to make such representation sounds like a miscommunication - especially in regards to the haziness of warranty situation which sounds like something they just made up off the top of their head.

The whole situation didn't sit well with me so I called back and they forwarded me to a shipping specialist and he didn't outright say send it back but they would appreciate if I did and that they would cover any shipping expenses if I decided to repurchase in the future. They sent me a shipping label to drop it off at UPS. I feel better :)

You did the right thing. :)

I just bought a Nexus 5 sight unseen off of the Google Play store (no one around here has them on display). I would have liked to play around with it for a bit before I bought, so it's good to see that Google isn't a hassle with returns.

Yeah most of us buy it sight unseen. Although tmobile USA stocks many these days you can try.

That's good to know. I've had nothing but iPhones so I've always been able to play with one, even for a minute or so on launch day.

I tried two Best Buys, a Radio Shack and a tmobile. None of them had any on display or in stock. I finally just took the plunge :D

Google knows the serial number of your phone and since you ordered it from them they know exactly when it was sold, when it shipped, and when it arrived at your house. I am not sure what reason they might give for denying the warranty.

So your choice is simple. If you really don't like it, then send it back.

Since the phone was not paid for, they will not honor the warranty. However, they will allow the OP to keep the phone as it was there mistake in shipping it or allowing it to be canceled.


It is probably not worth Google's time to charge the OP for their mistake when the law is questionably on the OP's side. This is assuming that Google did make an error in shipping or refunding the order.

I've been shipped things in error before after canceling and have always been told to keep it from shipper.

He cancelled AFTER they had already shipped. An important distinguishment. Google made no mistake shipping the item.

How do we know he cancelled after the item had already shipped? As far as I can tell, the OP never even received a shipment notification. In fact, I'd imagine the order would appear as cancelled under Google wallet.

The law is only good as your means to enforce it. Lets say google did charge him and claim that they are due the money OR the product back. The OP would then have the option of hiring a lawyer to file a suit against google in small claims court... which would certainly cost the OP more than $400 when all was said and done.
 
Hey guys. So I ordered the red nexus 5 and then 24 hours after I had buyers regret and canceled the order. The thing is the nexus 5 came today with UPS so I called Google to see what the deal was and the long and short of it was if I decide to keep the phone I get no warranty on the device but if I send it back and repurchase I get to take advantage of warranty. So basically I get a free phone :confused: ? I feel kind of bad almost like I want to send it back so I don't feel like i'm robbing them lol:( What would you guys do or does anyone have similar stories ?
