if i return it, will the new iphone cost me the same as new subscribers? and what will I use between the time i return it and the time of launch
 
Personally i'd be depressed and despondant. I probably wouldn't talk to anyone and become a hermit for about 40 years.

Thankfully though i didn't just buy an iPhone!
 
Give ATT and call and see what can be worked out.

Hold on to your currenty iPhone and upgrade to 3.0. If theres distinct advantages on the new one you must have, return it and wait for the new one to be released.
 
You can also threaten to terminate if they don't deal with you, :D! You don't really have to, but play around with them if they can't do much for you at first.

Businesses love taking money from you, they would hate to see you leave...
 
i asked 4 different AT&T guys on the phone and they all checked. my early upgrade starts June 6th, 2009. They said it is because of a system check and because I have a business account not a personal account. By System check they meant inventory update and that gives me the strongest hint AT&T will officially be updating their system with the new iPhones.

they were surprised as well because they said ussually early upgrades are 12-18 months into the contract not just 1 month. so maybe this is a special for the people who got the iphone 3g in the last couple of months.

Apparently, you weren't around for the fun last year.

You know, no one knew how to handle anything in regards to the iPhone 3G, especially ATT and Apple, even 2-3 weeks into the launch? Having a business account too was also a hurdle; you couldn't purchase the phone at Apple (sucked for those who waited on that 2 hr line in July, only to find out Apple was the only one with stock for the first few weeks!). I wouldn't be surprised if the same thing happens this year.

My point is, no one knows what's going to happen. The iPhone is a special product that gives Apple and ATT the power to literally change anything they want without any notice or without recognizing any precendent. You can ask ATT all you want, but no one there can give you a definite answer until a week or so before the launch.

That being said, if the system says your eligible date is June 5th, 2009 - then perhaps it is so. But, I'd take that with a grain of salt.

Like others have said, the only thing you can do now is, if you're within your return period, return the phone and wait. If you're not, hope that date means you can upgrade at that time.
 
You should respond as if you saw it coming - because everyone knows a new one will be coming out this summer. Everyone and their mothers. It's so obvious. You bought a year-old phone which has a known annual refresh cycle.

Spot on. The OP needs to recognize he made a conscious decision to buy the phone. Period. Even if he didn't see it coming, it was his decision to make the purchase - simply because he had bad timing shouldn't interfere with the legalities of the contract.
